- The site shall include a Category C buffer along all property lines bordered by
the RMF1 and SFR4 zoning districts. The 3 options under Category C are:
1) 20 feet with a certain amount of canopy trees, under story trees, and shrubs
/ ornamental grasses per 100 linear feet.
2) 10 feet with a certain amount of shrubs / ornamental grasses per 100 linear
feet and a wood fence or masonry wall.
3) 30 feet undisturbed natural buffer.
- Attitude of Property Owners
- Forty-nine (49) property owners within 300 feet of the subject properties were
notified of the rezoning request. The Planning Department received two calls
in opposition and one call inquiring about the rezoning.
- Additional Information
- The purpose of this rezoning request is to bring the existing site into
conforming status. The existing convenience store with gas sales is a legal
nonconforming use. The existing business has been there for 30+ years. RMF1
is a residential zoning and does not allow any commercial activity.
An existing legal nonconforming use prevents the business owner from
refinancing or borrowing against the business; it prevents the property owner
from replacing the existing store/pumps with a new store/pumps; and it prevents
the business owner from rebuilding if the business is destroyed by a natural
disaster.
