PLANNING ADVISORY COMMISSION RECOMMENDATION
Conditional approval based on the fact that it is consistent with the future

land-use map and a policy statement of the Comprehensive Plan and it is

compatible with existing land-uses. The recommended condition is: front

setbacks shall have a minimum setback of fifteen (15) feet.
PLANNING DEPARTMENT RECOMMENDATION
Conditional approval based on the fact that it is consistent with the future

land-use map and a policy statement of the Comprehensive Plan and it is

compatible with existing land-uses. The recommended condition is the same as

that recommended by the Planning Advisory Commission plus three additional

conditions: 1) restrictive covenants shall be required for the development, 2)

a smoke disclosure statement shall be required in all home sales. The

requirement for the disclosure shall be included in the restrictive covenants

of said development. A sample smoke disclosure statement is attached to this

ordinance and a completed smoke disclosure statement shall be filed by the

developer or subsequent grantor with the Clerk of Council and the Clerk of

Superior Court, 3) a noise disclosure statement shall be required in all home

sales. The requirement for the disclosure shall be included in the restrictive

covenants of said development. A sample noise disclosure statement is attached

to this ordinance and a completed noise disclosure statement shall be filed by

the developer or subsequent grantor with the Clerk of Council and the Clerk of

Superior Court, and 4) future construction shall meet the requirements of

General Storm Water Permit, including compliance with the National Pollutant

Discharge and Elimination System (NPDES) permitting and implementation of best

management practices.

The proposed zoning classification is consistent with the future land-use map

of the Comprehensive Plan.
School Impact
This development could have a maximum of 90 children of various ages.

Elementary age students would attend Georgetown Elementary, which has 470

students (capacity: 500). Middle school age students would attend East

Columbus Middle School, which has 717 students (capacity: 675). High school

age students would attend Kendrick, which has 1,073 students (capacity:

1,350).
Buffer Requirements
The proposed development shall have a Category A buffer requirement along all

property lines bordered by the GC zoning district. The 3 options under

Category A are:

1) 5 feet with a certain amount of shrubs / ornamental grasses per 100 linear

feet and a wood fence or masonry wall

2) 10 feet with a certain amount of understory trees and shrubs / ornamental

grasses per 100 linear feet

3) 20 feet undisturbed natural buffer.
Attitude of Property Owners
Forty-eight (48) property owners within 300 feet were notified of the rezoning

request. The Planning Division received one comment concerning the rezoning.
