Conditional approval. The PAC recommends that Condition #2 of Ordinance

#04-103 be amended to state: those lots numbered 1, 6, 7, 17, 18, 19, 25, 65,

70, 104, 117, 118, 119, 120, 121, and 129 on said plat shall remain zoned A-1,

shall be permitted to use R-1A front and side setbacks, and shall be subject to

a 40-feet rear setback. Also, a new condition (#4) shall be added: no more

than a total of 153 new lots shall be developed on the property subject to

rezoning combined with the property rezoned to R-1A and A-1 Districts by

Ordinance # 04-103.

Attitude of Property Owners
Thirty (30) property owners within 300 feet were notified of the rezoning

request. The Planning Department received comments opposing the rezoning

request.
Additional Information
During the rezoning of this property in 2004, Council and the developer agreed

to buffer A-1 properties with A-1 proposed lots. Thus, the lots surrounding

the Odom property met A-1 lot size requirements. If the Odom property is

rezoned, then the requirement of A-1 sized lots would not meet the intent of

the ordinance. Changing Condition #2 would create SFR2 lots bordering SFR2

lots, pursuant to approving rezoning of the Odom property.
