A Resolution Authorizing A VARIANCE REQUEST TO WAIVE THE MINIMUM STREET FRONTAGE REQUIREMENT IN ORDER TO \n \n CONSTRUCT A RESIDENTIAL SUBDIVISION AT 7500 LAYFIELD ROAD whereas, the preliminary plat for Upatoi Glen Subdivision has been submitted for \n \n approval by the Planning Director;
whereas, the applicant requests a variance to allow an access easement to satisfy street \n \n frontage requirements in order to construct a residential subdivision at 7500 \n \n Layfield Road (Upatoi Glen).
Article Three of the Columbus Unified Development Ordinance Section \n \n 7.3.5 (F.2) requires that all lots front on a minimum 25 feet of dedicated \n \n public right-of-way or upon a right-of-way that has received the legal status \n \n of such, except as provided for within specific zoning districts in Section \n \n 7.4.2; \n \n \n \n WHEREAS, Article 4, Section 7.4.2 (A) states that private streets, \n \n reserve strips or access easements are prohibited except in multi-family and \n \n nonresidential developments or as otherwise approved by the City Council on a \n \n case-by-case basis.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY
RESOLVES AS FOLLOWS:
1) That the criterion of Article 3, Section 7.4.2(A), which provides that \n \n all lots front on a minimum 25 feet of dedicated public right-of-way, is hereby \n \n waived for Upatoi Glen Subdivision (7500 Layfield Road) \n \n 2) All other requirements and conditions of the preliminary plat for Upatio \n \n Glen subdivision shall remain in full force and effect. \n \n 3) The access easement shall comply with all standards that apply to public \n \n streets within a residential subdivision and satisfy street frontage \n \n requirements
