A Resolution Authorizing A VARIANCE TO THE CITY SECTION 7.10.1 DELAYING THE REQUIREMENT FOR SIDEWALK \n \n CONSTRUCTION ALONG THE RIGHT OF WAY FRONTAGE AT 4306 15TH AVENUE UNTIL SIDEWALK \n \n IS CONSTRUCTED ON ADJOINING PROPERTIES. whereas, construction plans have been submitted for an office building and warehouse at \n \n the aforementioned property; and,
whereas, the developers of the property has requested a variance to City Code Section \n \n 7.10.1 which requires the construction of a 5 ft sidewalk as part of new \n \n construction; and,
WHEREAS, there are existing trees within the right of way that would have to be \n \n removed in order to construct the sidewalk.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY
RESOLVES AS FOLLOWS:
That a variance be granted to City Code Section 7.10.1 for the \n \n construction of sidewalks at 4306 15th Avenue, to allow the installation of \n \n sidewalks for this development be postponed until additional sidewalks are \n \n constructed on adjoining properties as specified by the City Engineer. This \n \n variance is granted on the condition that the property owner or its successors \n \n shall convey by deed or easement sufficient property for sidewalk purposes and \n \n shall pay for such improvements.
