A Resolution Authorizing A HARDSHIP VARIANCE REQUEST TO WAIVE THE MINIMUM STREET FRONTAGE REQUIREMENT IN \n \n ORDER TO CONSTRUCT A NONRESIDENTIAL STRUCTURE AT 8731 BIG SHINN ROAD whereas, the replat of Mason Hardaway Lampton Tract E and A (8731 Big Shinn Road) has \n \n been submitted for approval by the Planning Director.
whereas, Article Three of the Columbus Unified Development Ordinance Section 7.3.5 (F.2) \n \n requires that all lots front on a minimum 25 feet of dedicated public \n \n right-of-way or upon a right-of-way that has received the legal status of such, \n \n except as provided for within specific zoning districts in Section 7.4.2. \n \n \n \n WHEREAS, applicant has requested a hardship variance to waive said \n \n requirement pursuant to Article 3, Section 7.4.2 (A) which allows \n \n nonresidential developments to provide an access easement to properly satisfy \n \n street frontage requirements when approved by the City Council on a \n \n case-by-case basis; and

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY
RESOLVES AS FOLLOWS:
That the criterion of Section 7.4.2(A), which provides that all lots front on a \n \n minimum 25 feet of dedicated public right-of-way, is hereby waived. All other \n \n Planning conditions for approval of the replat of Mason Hardaway Lampton Tract \n \n E and A (Land Lot 22 and 43, 18th District) shall remain in full force and \n \n effect. A hardship variance to waive the street frontage requirement in order \n \n to construct a nonresidential structure on a landlocked lot is granted for the \n \n property located at 8731 Big Shinn Road.
