A Resolution Authorizing A VARIANCE REQUEST TO WAIVE THE MINIMUM STREET FRONTAGE REQUIREMENT IN ORDER TO \n \n CONSTRUCT A RESIDENTIAL SUBDIVISION AT 8851-4 MOORE ROAD (GREENLEAVES ESTATES) whereas, the preliminary plat for 8851-4 Moore Road (Greenleaves Estates) has been \n \n submitted for approval by the Planning Director.
whereas, the applicant requests a variance to allow an access easement to satisfy street \n \n frontage requirements in order to construct a residential subdivision at 8851-4 \n \n Moore Road. \n \n \n \n WHEREAS, Article Three of the Columbus Unified Development Ordinance \n \n Section 7.3.5 (F.2) requires that all lots front on a minimum 25 feet of \n \n dedicated public right-of-way or upon a right-of-way that has received the \n \n legal status of such, except as provided for within specific zoning districts \n \n in Section 7.4.2. \n \n \n \n WHEREAS, Article 4, Section 7.4.2 (A) states that private streets, \n \n reserve strips or access easements are prohibited except in multi-family and \n \n nonresidential developments or as otherwise approved by the City Council on a \n \n case-by-case basis.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the criterion of Article 3, Section 7.3.5(F2), which provides that all \n \n lots front on a minimum 25 feet of dedicated public right-of-way, is hereby \n \n waived at 8851-4 Moore Road (Greenleaves Estates). \n \n That the criterion of Article 4, Section 7.4.2(A), which states that private \n \n streets, reserve strips or access easements are prohibited except in \n \n multi-family and nonresidential developments, is hereby waived for the proposed \n \n residential subdivision at 8851-4 Moore Road (Greenleaves Estates). \n \n \n \n A hardship variance is granted for the subject property with the following \n \n conditions: \n \n \n \n The cul-de-sac portion of the existing 60-foot access easement running from \n \n Moore Road shall comply with the minimum radius requirement of 50 feet with a \n \n pavement radius of 40 feet. \n \n All other requirments and conditions of the preliminary plat shall remain in \n \n full force and effect. \n \n Proper drainage system shall be installed on the existing 60-foot access \n \n easement running from Moore Road to restore excess soil erosion and runoff. \n \n The shoulders of the existing 60-foot access easement running from Moore Road \n \n shall be cleared on each side by five (5) feet from the edge of the pavement to \n \n ensure necessary access for large public service vehicles. \n \n The existing 60-foot access easement running from Moore Road and the proposed \n \n cul-de-sac shall be named and maintained as a private street. \n \n Future subdivision development shall be restricted on adjacent properties. The \n \n use of the 60-foot access easement running off of Moore Road is limited to \n \n Greenleaves Estates subdivision and existing lots of record. No additional \n \n subdivision developments shall utilize the access easement and variance to \n \n accommodate future lots.
