A Resolution Authorizing TO WAIVE THE MINIMUM STREET FRONTAGE REQUIREMENT IN ORDER TO CONSTRUCT A \n \n RESIDENTIAL SUBDIVISION AT 8851-4 MOORE ROAD whereas, the preliminary plat for 8851-4 Moore Road has been submitted for approval by \n \n the Planning Director.
whereas, the applicant requests a variance to allow an access easement to satisfy street \n \n frontage requirements in order to construct a residential subdivision at 8851-4 \n \n Moore Road. \n \n WHEREAS, Article Three of the Columbus Unified Development Ordinance Section \n \n 7.3.5 (F.2) requires that all lots front on a minimum 25 feet of dedicated \n \n public right-of-way or upon a right-of-way that has received the legal status \n \n of such, except as provided for within specific zoning districts in Section \n \n 7.4.2. \n \n \n \n WHEREAS, Article 4, Section 7.4.2 (A) states that private streets, \n \n reserve strips or access easements are prohibited except in multi-family and \n \n nonresidential developments or as otherwise approved by the City Council on a \n \n case-by-case basis.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the criterion of Article 3, Section 7.3.5(F2), which provides that \n \n all lots front on a minimum 25 feet of dedicated public right-of-way, is hereby \n \n waived at 8851-4 Moore Road. \n \n \n \n That the criterion of Article 4, Section 7.4.2(A), which states that \n \n private streets, reserve strips or access easements are prohibited except in \n \n multi-family and nonresidential developments, is hereby waived for the proposed \n \n residential subdivision at 8851-4 Moore Road. \n \n \n \n A hardship variance is granted for the subject property with the \n \n following conditions: \n \n \n \n 1) All other requirements and conditions of the preliminary plat shall remain \n \n in full force and effect. \n \n 2) The existing access easement running from Moore Road and the proposed \n \n cul-de-sac shall comply with all standards that apply to public streets within \n \n a residential subdivision and satisfy street frontage requirements. \n \n 3) The existing 60-foot access easement running from Moore Road and the \n \n proposed cul-de-sac must meet the requirements of the Private Street Ordinance, \n \n be named, and accepted as a private street. \n \n 4) Three natural, undisturbed buffers shall be required. Two 30-foot buffers \n \n shall be required along the western and eastern boundaries of Greenleaf Estates \n \n Subdivision. An additional 30-foot buffer shall be required along the northern \n \n boundary of Greenleaf Estates
