A Resolution Authorizing THE ENGINEERING DEPARTMENT TO ISSUE A PERMIT TO COLUMBUS STATE UNIVERSITY FOR \n \n AN ENCROACHMENT ON THE RIGHT-OF-WAY FOR THE INSTALLATION OF TWO ELECTRIC \n \n TRANSFORMERS AT THE REAR OF THE PROPERTY LINE ON THE SOUTH SIDE OF 10TH STREET. whereas, Columbus State University is in the process of constructing a Theatre Art Dance \n \n Building located between Front Avenue and Bay Avenue; and,
whereas, two electric transformers are needed to service the building and Georgia Power \n \n has determined the best location for placing the transformers is on the City \n \n right-of-way;and,
WHEREAS, the transformers will encroach on the South right-of-way on 10th \n \n Street approximately 12 feet and will be screened and landscaped; and, \n \n WHEREAS, the Department of Engineering reviewed the request recommending the \n \n approval provided that should any future improvements to the Right-of-Way have \n \n a conflict with the Right-of-Way encroachment; then, the encroachment shall be \n \n removed by Columbus State University/Georgia Power at no expense to the City.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY
RESOLVES AS FOLLOWS:
That the Engineering Department is hereby authorized to issue a permit \n \n to Columbus State University for an encroachment into the Right-of-Way for the \n \n installation of two electric transformers on the South side 10th Street. Said \n \n encroachment includes the requirement that should the City need to make \n \n improvements to the Right-of-Way any time in the future ; then, Columbus State \n \n University or its successors shall remove the conflict at no cost to the City.
