1. Explanation of Revisions: Amend Section 4.2.9.C.1. by amending the entrance
and access to secondary uses for retail sales and personal services.

Sec. 4.2.9. Secondary Uses for Retail Sales and Personal Services
Section 4.2.9.C
C. Access and Advertising Limitations.
1. Entrances and Access. Access to secondary uses shall be located within
interior lobbies, hallways or similar areas. Exterior access is prohibited and
may not be waived by the Council.
2. Advertising. Secondary uses shall not utilize show or display window or
advertising or displays that are visible from the exterior of the building or a
public sidewalk or right-of-way.
3. Storage or Display. Display or storage of goods or materials associated with
a secondary use shall be located only within the interior premises of such use.

interior lobbies, hallways or similar areas unless waived through an
administrative change by a Planning or Codes/Inspections Department
representative.
2. Advertising. Secondary uses shall not utilize show or display window or
advertising or displays that are visible from the exterior of the building or a
public sidewalk or right-of-way.
3. Storage or Display. Display or storage of goods or materials associated with
a secondary use shall be located only within the interior premises of such use.
The definition of secondary uses per the UDO is as follows: Secondary uses
means those restricted uses that may be allowed within certain office, retail,
hotel or motel, or institutional uses, including the following: barber and
beauty shops, bookstores, cafeterias and restaurants, convenience food stores,
drugstores and pharmacies, florists, gift shops, newsstands and cigar or
tobacco shops, laundry and dry cleaning pickup/drop-off facilities, laundry
facilities for residents, mail services, personal services oriented to the
residents or tenants of the building, and print shops.
- PLANNING ADVISORY COMMISSION RECOMMENDATION
- The Planning Advisory Commission (PAC) considered this text amendment at their
meeting on April 16, 2014. The PAC recommended Approval.
- PLANNING DEPARTMENT RECOMMENDATION
- The Planning Department recommends Approval. This request was reviewed in
conjunction with the Inspection and Codes department and we are all in approval
of this change, since it will be up to our discretion to approve and will be
done in the case by case basis.
