Subject: (EXCP-10-14-2313) Special Exception Use request to operate a Restaurant as a

Special Exception Use at 222 7th Street.

Mike Milligan has submitted an application for the Special Exception Use cited

above. The property is located in an HIST (Historic) zoning district. The

site for the proposed restaurant was previously occupied by a restaurant. The

purpose of the Special Exception Use is to allow for the operation of a

restaurant in the HIST zoning district:

  1. Access. - Is or will the type of street providing access to the use be adequate to serve the proposed special exception use?
    7th Street is a local street in the original historic district. The grid

    system of the mixed-use neighborhood will provide reasonably free flow.
  2. Traffic and Pedestrian Safety. - Is or will access into and out of the property be adequate to provide for traffic and pedestrian safety, the anticipated volume of traffic flow, and access by emergency vehicles?
    There will be no impact to the transportation system, nor will there be any

    impact to pedestrian safety.
  3. Adequacy of Public Facilities. - Are or will public facilities such as schools, water or sewer utilities, and police or fire protection be adequate to serve the special exception use?
    Services such as water, sewer, utilities, police, and fire protection will be

    adequate and serve the proposed use at this location.
  4. Protection from Adverse Affects. - Are or will refuse, service, parking and loading areas on the property be located or screened to protect other properties in the area from such adverse effects as noise, light, glare or odor?
    The Historic District (HIST) has no required parking on site. Parking for a

    comparable use outside of the HIST District would require 19 parking spaces

    onsite. On-street parking will be utilized for this site. The Planning

    Department has requested the petitioner to locate and plan for additional

    parking in a satellite location. No side and rear and buffers are required

    since the site is surrounded by HIST zoning classification. Street buffer

    shall be provided in accordance of Section 4.5.8 of the UDO. External

    dumpsters/compactors and lighting are addressed in the UDO. Noise impacts are

    addressed in the City Code.
  5. Hours of Operation. - Will the hours and manner of operation of the special exception use have no adverse effects on other properties in the area?
    The hours of operation for this use will not have an adverse impact on the

    neighboring properties in the area. The applicant stated that the proposed

    restaurant will be operating for lunch (Sun, M, W, Th, F, and Sat from 11:30 am

    to 2:00 pm) and dinner (Sun, M, and W from 5:30-9:30 pm and Th-Sat from

    5:30-10:30 pm). They will be closed on Tuesday.
  6. Compatibility. - Will the height, size or location of the buildings or structures on the property be compatible with the height, size, character or location of buildings or other structures on neighboring properties?
    The height, size and location of the proposed structure will be compatible with

    other structures on neighboring properties.

The applicant is seeking to reuse the former Caf? 222 as a restaurant. This is

now a permitted use in the HIST District per Ordinance 15-6 as adopted on

2/10/2015.

The Planning Advisory Commission recommended Approval at the May 06, 2015

meeting.

The Planning Department recommends that the Council Approves the use because

the application for a Special Exception use meets the criteria for approval.
