Subject: (EXCP-10-12-2959) Special Exception to allow Existing Buildings in Neighborhood

Commercial Districts that are Greater than 5,000 Square Feet for the Property

located at 3604 Macon Road.

On September 25, 2012 Trey Carmack submitted a Special Exception Use

application to allow existing buildings in neighborhood commercial districts

that are greater than 5,000 square feet in a neighborhood commercial zoning

district. The property is located in a NC (Neighborhood Commercial) zoning

district. The site is approximately 5.74 acres. Uses of 5,000 or more square

feet are only allowed in a GC (General Commercial) zoning district. Uses that

exceed 5,000 square feet in a NC (Neighborhood Commercial) zoning district are

allowed as a special exception use as provided in Section 3.1.1 of the Unified

Development Ordinance.



Attached is a land use map showing the location of the property along with the

current/proposed site plan. The Planning Department has included the request

on Council?s November 27th?s agenda. A staff report has been sent to the Clerk

of Council.
