Subject: (SEU0806-2) Special Exception Use request for the operation of a Personal Care

Home, Type II, located at 6225 Olde Town Drive.



Stephanie Coley / Health Services submitted an application for the Special

Exception Use cited above. The property is located in an RMF1 (Residential

Multi-Family 1) District. The purpose of the Special Exception Use is to allow

for the operation of a Personal Care Home, Type II. This type of personal care

home allows between 7 and 18 residents on the property. The proposed personal

care home will have 4 residents in each triplex unit. Other issues are

addressed below:



(1) Access: Is or will the type of street providing access to the use be

adequate to serve the proposed special exception use?



Access to the property is adequate for the proposed use. Three driveways exist

on the property but residents will not have their own cars. There will be 1

van and 3 staff vehicles on the premises.



(2) Traffic and Pedestrian Safety: Is or will access into and out of the

property be adequate to provide for traffic and pedestrian safety, the

anticipated volume of the traffic flow, and access by emergency vehicles?



There will be no impact to the transportation system nor will there be any

impact to pedestrian safety.



(3) Adequacy of Public Facilities: Are or will public facilities such as

school, water, or sewer utilities and police and fire protection be adequate to

serve the special exception use?



There will be no impact to public facilities.



(4) Protection from Adverse Affects: Are or will refuse, service, parking and

loading areas on the property be located or screened to protect other

properties in the area from such adverse effects as noise, light, glare or odor?



It will not adversely affect surrounding properties.



(5) Hours of Operation: Will the hours and manner of operation of the special

exception use have no adverse effects on other properties in the area?

(6) Compatibility: Will the height, size, or location of the buildings or other

structures on the property be compatible with the height, size, character, or

location of buildings or other structures on neighboring properties?



The triplex is compatible with neighboring properties.



Twenty-five (25) property owners within 300 feet of the parcel were notified by

letter of the proposed Special Exception Use. The Planning Department received

one comment inquiring about the Special Exception Use request. At PAC, 4

residents spoke against the use and 1 submitted a petition in opposition.



The Planning Advisory Commission recommended denial at the July 16, 2008

meeting by a vote of 3-to-2.



The Planning Department recommends that the Council approve the use because the

application for a Special Exception Use meets the criteria for approval.
