At the Council meeting on August 11,2009, there was a discussion regarding a
condition put into an earlier zoning ordinance regarding this same property.
It is believed the original intent of the condition in the 01-35 ordinance was
to require a higher level of detention, 100-yr, than was the standard 10yr.
level. This would require a higher volume of storage for the increased runoff
generated by the development. The standard included in the 01 ordinance is now
part of the standard requirements as included in Section 7.12.6A (3) of the
UDO which contains: "Detention Requirements. Detention shall be provided such
that the peak rate of flow from the site after development will not exceed the
corresponding flow that would have been created by the 2-year, 10-year, 25-year
and 100-year return frequency storms prior to development." The current
requirement is the standard that is enforced routinely by the Department of
Engineering for developments.
