Subject: National Infantry Museum Resolution


Attached is the proposed resolution for removing the Quit Claim Deed

reversionary clause on the property owned by the National Infantry Museum. The

clause was placed on the property when it was deeded to the Museum and requires

the property only be used for museum purposes.

Removing the clause would allow the Museum opportunity to initially utilize the

property for collateral for future building needs. Our recommendation is to

remove the clause, but only on the conditions that 1) a master plan for the

site to be approved by both the Museum and the City that provides a connecting

roadway between South Lumpkin Road and Fort Benning Boulevard; and 2) that the

property be subject to all zoning requirements as established by the Unified

Development Ordinance. This last conditions insures that the Museum is aware

that it must rezone the property to the City's satisfaction and provides the

Council a final review and approval of any development that may occur on this

site.





A RESOLUTION

WHEREAS, Council Resolution No. 145-04 approved the transfer of 90.64 acres of

land to the National Infantry Foundation, Inc. with a Quit Claim Deed

reversionary clause should the property no longer be used for museum purposes;



WHEREAS, Resolution No. 7-06 authorized the execution of an agreement between

the National Infantry Foundation, Inc. and the City of Columbus, Georgia which

contained the deed restriction referred to above;



WHEREAS, in order to secure final construction financing for the National

Infantry Museum, the Foundation has requested removal of said deed restriction;



WHEREAS, it has been determined that the Foundation and the City must agree and

approve a master plan concept for the remaining undeveloped land on this site,

to include a proposed connecting roadway from South Lumpkin Road to Ft. Benning

Boulevard;



WHEREAS, this Council deems the removal of said deed restriction to be in the

public interest and in furtherance of the National Infantry Museum project.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:



We hereby authorize the City Manager to execute a Quit Claim Deed of Release

and the Amended and Restated Agreement between the National Infantry

Foundation, Inc. and the City of Columbus, Georgia. The National Infantry

Foundation, Inc. shall develop and submit a master plan concept prior to any

construction for the remaining undeveloped property on this site, to include a

potential connecting roadway between South Lumpkin Road and Ft. Benning

Boulevard. The property shall also be subject to any and all zoning

requirements for this property.
