Please see responses to the referrals from Tuesday, September 12, 2006 Council

Meeting below.



DEMOLITION PERMITS



Have the staff to look at the language that is currently in the demolition

permits as to the date the permit is to expire and get together with the City

Attorney and if it is determined that the language is unclear, the issue needs

to be resolved in the favor of the person who receives the demolition notice.

PROPOSED FLOYD ROAD REZONING:



Have the staff to determine if the City did work on a private project with City

machinery in relation to a detention pond around Floyd Court and Acorn Street.

Have the staff to go to Floyd Court and find out why there is continual

flooding in this particular area and determine what we can do to assist the

citizens who live on Floyd Court, Acorn Street, and Burke Street to alleviate

the water that continues to flood their property. (Request of Councilor

Suber)

DUMPSTERS:



Have the staff to look at putting some additional teeth in the ordinance, which

would involve the maintaining of the current dumpsters, as they exist.

Before we bring this ordinance back for discussion, let?s have the staff to go

out and take pictures of these dumpsters that we are talking about so that we

can take a look at them and discuss them. (Request of Councilor Turner Pugh)



Have the staff to look at the ordinance going forward and consider putting in

some type of catch-up clause that existing dumpsters would have to comply with

the new ordinance by a certain date in the future. Also, have the staff to

look at possibly having a certain schedule for apartments and commercial units

for pick-up. (Request of Councilor Allen)



Response: Staff is working on this referral and will provide an update at a

future work session.





CONCERNS OF MR. FRANK COMER:



Have the staff to talk with the Police Chief regarding those concerns expressed

by Mr. Comer. (Request of Councilor Suber)



Response: This referral has been forwarded to the Police Chief for handling.





PUBLIC NOTICE:



Have the staff to provide proper notification to the citizens regarding the

proposed ordinance as it relates to requirements for existing non-conforming

dumpsters. (Request of Mayor Poydasheff)



Response: Staff is working on this referral and will provide a report.





BILLIE DRIVE:



Have the Traffic Engineer to go out and look at the possibility of closing the

driveway at Billy Drive and consider allowing them to use the Armour Road

driveway. (Request of Councilor McDaniel)



Response: Ron Hamlett, Traffic Engineer, pulled up the aerial photography to

see how the building is located on the lot. This is a residential structure

that has been renovated for a commercial use. There is not enough room to

construct a two-way driveway between the building & the south property line or

between building & Billie Dr.



Therefore, we cannot approve a commercial driveway access to Armour Rd.

CLERK OF SUPERIOR COURT FEES:



Have the staff to look into whether or not the interest that has been generated

off of those monies has been removed by the Clerk of Superior Court, and used

for various other costs associated with her department. (Request of Councilor

Allen)



Response: Staff will research this issue and provide a report.
