SUBJECT: Columbus Water Works Land Swap
INITIATED BY: Department of Community Reinvestment
Recommendation: Approval is requested to declare city property totaling 106
+/-acres as identified on the attached map marked in red surplus and enter into
a Memorandum of Understanding with the Columbus Water Works to exchange 106 +/-
acres as identified on the attached map marked in green for the 106 +/- acres
of City property as identified on the attached map marked in red.
Background: Columbus State University approached the city of Columbus about
continued use of the pond located near the Columbus State University
Environmental Learning Center. The pond is a vital component of the Learning
Center and without the pond the long-term viability of the Center would be in
jeopardy. The University asked the City to donate the land for use by the
Learning Center to ensure the long-term viability of the Center. The Pond is
owned by the City and the planned use of the pond was an Inert Landfill site.
The City has worked with the University and the Columbus Water Works to develop
a viable solution for both the City and University.
Analysis: The Environmental Learning Center is a key component of the Oxbow
Meadows Project. The exchange of property will allow for the continued
development of the Oxbow Meadows Project. The exchange will also provide the
University the use of the pond to continue the operation and possible expansion
of the Learning Center. The exchange will also provide property for the City
to meet its needs in the future.
Financial Considerations: The exchange of property will not include the
exchange of funds between the two parties. The cost incurred to transfer the
property will be divided between both parties to be outlined in the Memorandum
of Understanding.
Legal Considerations: The transfer or exchange of property requires Council
approval.
Recommendations: Approve the attached Resolution to declare City property
totaling 106 +/-acres as identified on the attached map marked in red surplus
and to authorize the City Manager to enter into a memorandum of understanding
with the Columbus Water Works to exchange 106 +/- acres as identified on the
attach map marked in green for the 106 +/- acres of City property as identified
on the attached map marked in red.
A RESOLUTION

A RESOLUTION TO DECLARE CITY PROPERTY TOTALING 106 +/-ACRES AS
IDENTIFIED ON THE ATTACHED MAP MARKED IN RED SURPLUS AND TO AUTHORIZE THE CITY
MANAGER TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE COLUMBUS WATER
WORKS TO EXCHANGE 106 +/- ACRES AS IDENTIFIED ON THE ATTACH MAP MARKED IN GREEN
FOR THE 106 +/- ACRES OF CITY PROPERTY AS IDENTIFIED ON THE ATTACHED MAP MARKED
IN RED.
WHEREAS, the above mentioned City property is owned exclusively by the
Columbus Consolidated Government; and,
WHEREAS, the above mentioned Columbus Water Work property is owned
exclusively by the Columbus Water Works; and,
WHEREAS, the Memorandum of Understanding will provide the structure for
the City and the Columbus Water Works to exchange the property; and,
WHEREAS, the cost incurred to transfer the property will be divided by
the two parties to be outlined in the Memorandum of Understanding; and,
WHEREAS, the exchange of properties will support the continued
operation and possible expansion of the Columbus State Environmental Learning
Center; and,
WHEREAS, the exchange of properties will provide sufficient property
for the City to meet the current and future needs for the Oxbox Development
project; and,
WHEREAS, it is in the best interest of the City of Columbus to declare
above mention property surplus and complete the land swap with the Columbus
Water Works.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS
FOLLOWS:
That the City Manager is hereby authorized to:
1. Declare said City property described above as surplus,
2. Enter into a Memorandum of Understanding with the Columbus Water
Works as it pertains to the exchange of 106 +/- acres of property for an equal
amount of 106 +/1 acres,
3. Transfer of above mentioned City property to the Columbus Water
Works and acceptance of property from Columbus Water Works for an equivalent
amount of property; and,
4. Execute all contracts, agreements and understandings related to the
conveyance of City properties.
Introduced at a regular meeting of the Council of Columbus, Georgia,
held the _________day of _____________, and adopted at said meeting by the
affirmative vote of ____________members of said Council.
