SUBJECT: Unified Certification Program update for Disadvantaged Business
Enterprise Program
INITIATED BY: Finance Department
Recommendation: Approval is requested to update the Memorandum of
Understanding with Georgia Department of Transportation for the Unified
Certification Program, which is an element of the City?s Disadvantaged Business
Enterprise Program for FTA and FHWA Contracts.
Background: Since the City receives more than $250,000 in federal funding each
year, through the transit and transportation programs, the City is required to
have in place a Disadvantaged Business Enterprise (DBE) program. The program
must include procedures for certifying potential vendors and maintaining a
directory of certified vendors. This requirement is consistent with the laws,
rules and regulations of Title VI of the 1964 Civil Rights Act and 49 Code of
Federal Regulations, Parts 23 and 26.
Per Resolution No. 373-99 and updated by Resolution No. 209-13, Columbus
Council authorized the adoption of a DBE Program in order to encourage and
foster DBE participation in USDOT funded procurement. The resolution further
authorized a previous City Manager to sign the policy statement and for the
appropriate staff to implement the program. Additionally, Resolution No.
373-99 authorized the City to participate with the Georgia Unified
Certification Program (UCP). Through the UCP Program, Georgia Department of
Transportation (GDOT) is the lead agency that performs DBE certification
procedures and maintains a UCP Directory for all Georgia UCP participants.
Analysis: The original Memorandum of Understanding for the Unified
Certification Program was signed in January 2002. The Georgia Department of
Transportation requires the City Manager to sign an updated Memorandum of
Understanding (UCP), due to the length of time that has elapsed since the
original UCP was signed. The agreement and responsibilities remain the same
and the substantive language of the MOU remains essentially unchanged from the
original MOU.
Financial Considerations: The City will not incur additional expenses by
signing the Memorandum of Understanding for the Unified Certification Program.
Legal Considerations: Columbus Consolidated Government is in compliance with
all applicable requirements and certifications necessary to receive the Federal
and State funds.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN THE UPDATED MEMORANDUM OF
UNDERSTANDING WITH GEORGIA DEPARTMENT OF TRANSPORTATION FOR THE UNIFIED
CERTIFICATION PROGRAM, WHICH IS AN ELEMENT OF THE CITY?S DISADVANTAGED BUSINESS

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to sign the updated
Memorandum of Understanding with Georgia Department of Transportation for the
Unified Certification Program, which is an element of the City?s Disadvantaged
Business Enterprise Program for FTA and FHWA Contracts.
