SUBJECT: Easement For Area ?A?, 0.827 Acres
Eagle & Phenix Mills, LLC
INITIATED BY: Department of Community Reinvestment
Recommendation: Approval is requested to grant an easement for use, access and
landscaping to Eagle & Phenix Mills, LLC pursuant to the terms and conditions
set forth in the ?EASEMENT FOR USE, ACCESS AND LANDSCAPING?, in Columbus,
Muscogee County, Georgia. (See Easement and Attachment Exhibit ?A?.)
Background: W.C. Bradley Company conveyed to Columbus, Georgia on February 1,
2008 Area ?A?, 0.827 acres Part of Water Lots 18 and 19 shown on a map or plat
entitled ?Survey for W. C. Bradley Co.? (Attached). Eagle & Phenix Mills, LLC,
desires the perpetual use, access an landscape easement and the right to plant,
construct, replace, remove, maintain or modify landscaping, upon, over and
across any portion of said Area ?A?.
Analysis: Eagle & Phenix Mills, LLC shall be solely responsible for all costs
related to any construction, maintenance activities or maintaining the
landscaping it undertakes related to the Easement at no cost to the City. The
easement will provide access to the deck to be constructed. The easement will
not interfere with the current use of the property. The easement would be
granted with conditions as provided on the attachment.
Financial Considerations: There will be no financial obligation of the City.
Legal Considerations: The granting of an easement on City property to Eagle &
Phenix Mills, LLC requires the approval of Council.
Recommendations/ Actions: Approve the Resolution authorizing the City Manager
to grant an easement to Eagle & Phenix Mills, LLC on property located over and
through the right of way of Area ?A? 0.827 acres Part of Water Lots 18 and 19
in Columbus, Muscogee County, Georgia.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO GRANT AN EASEMENT FOR USE, ACCESS
AND LANDSCAPING TO EAGLE & PHENIX MILLS, LLC PURSUANT TO THE TERMS AND
CONDITIONS SET FORTH IN THE ?EASEMENT FOR USE, ACCESS AND LANDSCAPING?, IN
COLUMBUS, MUSCOGEE COUNTY, GEORGIA.
WHEREAS, the W.C. Bradley Co. conveyed to Columbus, Georgia Area A,
0.827 acres Part of Water Lots 18 and 19; and,
WHEREAS, the easement will be granted for the purpose of use, access,
landscaping and maintenance over a portion of Area ?A? Part of Water Lots 18
and 19 at no cost to the City; and,
WHEREAS, granting of an easement will not interfere with the current
use of the property.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to grant an easement for use, access
and landscaping to Eagle & Phenix Mills, LLC on City property located over and
through the right of way of Area ?A?, 0.827 acres, Part of Water Lots 18 and 19
in Columbus, Muscogee County, Georgia.
