SUBJECT: Agreement with Georgia Southwestern Railroad, Inc.



INITIATED BY: Engineering Department







Recommendation: Approval is requested to execute an agreement with Georgia

Southwestern Railroad, Inc., (GASW) for reimbursement of expenses incurred for

railroad crossing improvements at crossing on Old Cusseta Road.



Background: Council approved Resolution No. 428-08 on September 9, 2008, to

authorize the City Manager to execute an agreement with GASW for crossing

improvements. The City has an ongoing effort to improve railroad crossings

throughout the community. The Departments of Engineering and Public Services

have investigated this crossing for alternative improvements. The Department

of Engineering recommends replacement/upgrade of the crossing due to the

temporary measures that have been made in the past are no longer effective and

the volume of traffic crossing this location.



Analysis: GASW never fulfilled the obligations under the contract and no

longer utilize the rubberized crossing materials that were part of the original

proposal. GASW has submitted a new estimate of cost $34,150 to upgrade the

crossing with the use of concrete panels similar to what has been used at other

crossing within the City. The original estimate approved in 2008 was $8,956.



Financial Considerations: Funds are available in the 1999 SPLOST Railroad

Crossing Improvements Account.



Projected Annual Fiscal Impact Statement: N/A Reduce the amount of staff time

responding to the numerous complaints/request received for this location.



Legal Considerations: Council is the approving authority for all resolutions.



Recommendations/ Actions: Authorize the resolution for the City Manager to

execute an agreement with Georgia Southwestern Railroad, Inc. (GASW) for

reimbursement of expenses incurred for railroad crossing improvements at

crossing on Old Cusseta Road.























A RESOLUTION

A RESOLUTION AUTHORIZING TO EXECUTE AN AGREEMENT WITH GEORGIA SOUTHWESTERN

RAILROAD, INC. FOR RAILROAD CROSSING IMPROVEMENTS AT OLD CUSSETA ROAD IN THE

AMOUNT OF $34,150.00,

WHEREAS, Council approved Resolution No. 428-08 authorizing the City Manager

to enter into agreement with Georgia Southwestern Railroad, Inc for the

crossing improvement on Old Cusseta Road in the amount of $8,956.90; and,

WHEREAS, Georgia Southwestern Railroad, Inc., no longer utilizes the rubberized

crossing materials that were part of the original agreement and has submitted

a new estimate for upgrading to concrete panels; and,

WHEREAS, the City will coordinate the work schedule with Georgia Southwestern

Railroad, Inc., and reimburse Georgia Southwestern Railroad, Inc., for the

material cost.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to enter into an agreement with

Georgia Southwestern Railroad, Inc., (GASW) for reimbursements of material for

railroad improvements at Old Cusseta Road in the amount of $34,150.
