SUBJECT: Norfolk Southern Railway Company Construction Agreement
INITIATED BY: Donna W. Newman, Director of Engineering
Recommendation: Approval is requested to execute a construction agreement with
Norfolk Southern Railway Company for construction work associated with the
replacement of the City's combined sewer system along the 6th Avenue Corridor
and Side Streets.
Background: The City is under contract on the Flood Abatement Project-6th
Avenue and Side Streets Improvements. Norfolk Southern Railway Company owns a
track in the vicinity of 9th Street that will need to be removed in order to
install a 10' x 8' culvert.
Analysis: In order to work within the limits of the track, it will require
permits from Norfolk Southern Railway Company with certain terms and conditions
which include implementation of a construction agreement.
Financial Considerations: The agreement includes payment estimated at
$271,669 to Norfolk Southern Railway Company for construction engineering,
administration, flagging services and track work. Funds are available in 2010B
Bonds -6th Avenue Stormwater/Flood Abatement Project.
Projected Annual Fiscal Impact Statement: No funds will be required with the
exception of normal maintenance which should be minimal.
Legal Considerations: Council is the approving authority for all resolutions.
Recommendations/ Actions: Authorize the City Manager to execute a construction
agreement with Norfolk Southern Railway Company for replacement of the City's
combined sewer system along the 6th Avenue Corridor and Side Streets.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH NORFOLK
SOUTHERN RAILWAY COMPANY TO ACCOMMODATE THE REPLACEMENT OF THE CITY'S COMBINED
SEWER SYSTEM ASSOCIATED WITH THE 6TH AVENUE AND SIDE STREETS FLOOD ABATEMENT
PROJECT.
WHEREAS, the City proposes to construct a box culvert as part of the 6th Avenue
Flood Abatement Project within the right of way or property of Norfolk Southern
Railway Company in the vicinity of 9th Street or Railway Milepost S-291.65; and,
WHEREAS, Norfolk Southern Railway Company is willing to permit the Project upon
railroad right of way, but upon the execution of an agreement with certain
terms and conditions; and,
WHEREAS, the City agrees to reimburse Norfolk Southern Railway Company for
expenses associated with construction engineering, administration, flagging
services and track work estimated at a cost of $271,669.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to execute an agreement with
Norfolk Southern Railway for the required work to construct a 10' x 8' box
culvert within the railroad right of way as part of the 6th Avenue and Side
Streets Flood Abatement Project. Funds are available in the 2010B Bonds 6th
Avenue Stormwater/Flood Abatement Project.
