SUBJECT: Resolution for the action to execute Quit Claim Deed to The
State of Georgia
INITIATED BY: Felton G. Grant, Right of Way Acquisition Coordinator
Recommendation: Approval is requested to execute a resolution supporting the
need and insuring the State, a Quit Claim Deed for 0.474 acres+/- will be
executed after the resolution has been approved by Council. This action is in
support of the construction of the Eastern Connector from Buena Vista Road to
Chattsworth Road project. PI#35850.
Background: The City is responsible for the acquisition of said project
and has acquired 0.474 acres+/- to certify Right of Way. The State issued a
Revocable License Agreement to the City awaiting the State Legislation to
approve Final Right of Way Transaction.
Analysis: Action can not be complete until a resolution is executed by the
City to allow the State to add to the 2013 Legislation that will be their
legislative agenda, but they need, a resolution number no later than noon on
February 28, 2013.

Projected Annual Fiscal Impact Statement: NA
Legal Considerations: Council must approve the action by resolution.

A RESOLUTION

A RESOLUTION AUTHORIZING SUPPORTING AND INSURING THE STATE OF A QUIT CLAIM
DEED OF 0.474 ACRES+/-WILL BE EXECUTED AFTER THE RESOLUTION HAS BEEN APPROVED
BY COUNCIL. THIS ACTION IS IN SUPPORT OF THE CONSTRUCTION OF THE EASTERN
CONNECTOR FROM BUENA VISTA ROAD TO CHATTSWORTH ROAD PROJECT STP00-8042-00(006),
PI 350850.
WHEREAS, the City is responsible for the acquisition of said project and has
purchased needed property by a Revocable License Agreement from the State; and,
WHEREAS, to be able to certify Right of Way before the deadline, the state of
Georgia issued a Revocable License Agreement to the city of Columbus, Ga. so
Columbus/GDOT could Let the project (Let date April 2013) at the scheduled
time; and,
WHEREAS, a copy of the original Deed Book 1166, Page 163 signed the 21st day
of March, 1968 and is permanently attached to this resolution; and,
WHEREAS, a copy of the description of Revocable License Agreement Attachment
"A" is permanently attached to this resolution; and,
WHEREAS, this resolution supporting the need and insuring the State, a Quit
Claim Deed for 0.474 acres+/-will be executed after resolution has been
approved by Council. Resolution has to be executed in short order to make the
start of the Legislation for the Revocable License Agreement can be voided.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby requesting a resolution be executed
supporting and assuring the state of Georgia that a Quit Claim Deed for 0.474
acres+/- will be executed after the resolution has been approved by Council.
This action is in support of the construction of the Eastern Connector from
Buena Vista Road to Chattsworth Road Project STP00-8042-00(006), PI 35850.

Introduced at a regular meeting of the Council of Columbus, Georgia, held
