AN ORDINANCE

An Ordinance requiring use of personal floatation devices (PFDs) when swimming,

canoeing, kayaking, rafting, jet-skiing or boating on the Chattahoochee River

between the North Highlands Dam and the southern property line of the Columbus

Iron Works Convention and Trade Center; providing an exception for sanctioned

swimming events or competitions; and for other purposes.

THE COUNCIL OF COLUMBUS, GEORGIA HEREBY ORDAINS:



SECTION 1.



Chapter 14 of the Columbus Code is hereby amended by adding a new

Section 14-45 to read as follows:





?14-45 (a) Personal floatation devices (PFDs) required on Chattahoochee River

between North Highlands Dam and the southern property line of the Columbus Iron

Works Convention and Trade Center.



It shall be unlawful for any person to swim, canoe, kayak, raft,

jet-ski, or use any other vessel on the Chattahoochee River between the North

Highlands Dam and the southern property line of the Columbus Iron Works

Convention and Trade Center without wearing a personal floatation device as

defined in O.C.G.A. Section 52-7-3.



For purposes of this Code section, ?vessel? shall have the meaning set forth in

O.C.G.A. Section 52-7-3.



(b) The provisions of subsection (a) shall not apply to sanctioned swimming

events or competitions where rescue personnel are present.?



SECTION 2.



Columbus Code Section 14-47.1 is hereby amended by deleting subsection

(d) in its entirety and by substituting a new subsection (d) to read as follows:



?The provisions of this section shall not apply to recreational

activities that occur in and beside the Chattahoochee River as part of the

creation of the Chattahoochee River Park from the North Highlands Dam to the

southern property line of the Columbus Iron Works Convention and Trade Center.?



SECTION 3.



Columbus Code Section 14-47.3 is hereby amended by deleting the second

sentence in its entirety and substituting a new second sentence to read as

follows:



?The provisions of this section shall not apply to recreational

activities that occur in and beside the Chattahoochee River as part of the

creation of the Chattahoochee River Park from the North Highlands Dam to the

southern property line of the Columbus Iron Works Convention and Trade Center.?



SECTION 4.



Columbus Code Section 14-47.5 is hereby repealed in its entirety and a

new Section 14-47.5 is hereby substituted to read as follows:



?It shall be unlawful for any person to go swimming or to permit a

minor in his or her custody or care to go swimming within 300 feet of any

municipal docks south of the southern property line of the Columbus Iron Works

Convention and Trade Center.?



SECTION 5.





All ordinances and parts of ordinances in conflict with this ordinance

are hereby repealed.
