SUBJECT: Street Acceptance - Old Guard Road and Extension of American
Way
INITIATED BY: Engineering
Recommendation: Approve the acceptance of the deed to Old Guard Road and the
extension of American Way located in part of Land Lots 264 and 269, 19th
District. Accept an easement where a portion of the guard rails which were
erected as a condition of the street acceptance, are located on private
property.
Background: Old Guard Road and the extension of American Way were
constructed for access to North Columbus Elementary School and Veterans
Memorial Middle School. The streets have been improved and meet the required
specifications for acceptance by the City.
Analysis: A deed has been conveyed to the City conveying Old Guard Road and
the extension of American Way. All that tract or parcel of land situate, lying
and being in Columbus, Muscogee County, Georgia, and comprising all of Old
Guard Road and the extension of American Way, as said streets are shown upon
that certain map or plat entitled "Right-of-Way Survey of Part of Land Lots 264
and 269 19th District, Columbus, Muscogee County, Georgia" dated July 13, 2007,
and revised August 15th, 2012, recorded in Plat Book 163, pages 245 and 246, in
the Office of the Clerk of Superior Court of Muscogee County, Georgia, and to
which map or plat reference is hereby made for a more particular description of
the street conveyed hereby.
Financial Considerations: The streets have been in existence since 2007 and
were constructed by the Muscogee County School District. The City has assumed
maintenance of the streets.
Projected Annual Fiscal Impact Statement: Any repairs to the streets and or
traffic control signage will be paid for from the Engineering Department's
Operating budget.
Legal Considerations: In Accordance with Section 18-3 of the Columbus Code,
all dedicated right-of-ways must be accepted by written resolution of Council.
Recommendations/ Actions: Approve the Resolution accepting the deed to Old
Guard Road and the extension of American Way. Accept an easement where a
portion of the guard rails which were erected as a condition of the street
acceptance, are located on private property.

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A DEED TO OLD GUARD ROAD AND THE
EXTENSION OF AMERICAN WAY AND THE ACCEPTANCE OF A GUARD RAIL EASEMENT ON OLD
GUARD ROAD, ON BEHALF OF COLUMBUS, GEORGIA.
WHEREAS, Columbus, Georgia has been submitted a deed conveying to
Columbus, Georgia, Old Guard Road and the Extension of American Way located in
part of Land Lots 264 and 269, 19th District; a full description of said
streets being shown in said deed; and,
WHEREAS, Columbus, Georgia has been submitted a guard rail easement on Old
Guard Road given by Calvin S. Koonce; and,
WHEREAS, said streets have been improved and meet the required specifications
for acceptance by the City; and,
WHEREAS, the Engineering Department of Columbus, Georgia has inspected said
streets for acceptance by the City, and recommends acceptance of same.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That certain deed dated the 25th day of February, 2013 conveying to
Columbus, Georgia all of Old Guard Road and the Extension of American Way,
located in Land Lots 264 and 269, 19th District, be and the same hereby
accepted. That certain Guard Rail Easement given to Columbus, Georgia by Calvin
S. Koonce, be and the same hereby accepted. A copy of the said deed and guard
rail Easement are hereto attached and by the made a part of this resolution.

Introduced at a regular meeting of the Council of Columbus, Georgia, held
