SUBJECT: Street Acceptance - that portion of Westwind Drive and that

portion of

Windward Drive located in Section Five Crosswinds



INITIATED BY: Engineering







Recommendation: Approve the acceptance of a deed to that portion of Westwind

Drive and that portion of Windward Drive located in Section Five Crosswinds.



Background: That portion of Westwind Drive and that portion of Windward Drive

located in Section Five Crosswinds has (8) eight residential lots. The streets

have been improved and meet the required specifications for acceptance by the

City.



Analysis: A deed has been conveyed to the City conveying that portion of

Westwind Drive and that portion of Windward Drive located in Section Five

Crosswinds. A description of property is as follows: All those lots, tracts

and parcels of land lying and being in Land lots 40 & 41 of the 18th District,

Columbus, Muscogee County, Georgia, and shown as Westwind Drive and extension

of Windward Drive lying in Section Five of Crosswinds Subdivision, as said

roads and right-of-way is shown on the map or plat entitled "Section Five,

Crosswinds Lying in Land Lots 40 & 41, 18th District, Columbus, Muscogee

County, Georgia" prepared by Hobbs Smith & Assoc., Inc., dated June 4, 2010,

said recorded in Plat Book 162, page 272, in the Office of the Clerk of

Superior Court of Muscogee County, Georgia.



Financial Considerations: No City funds are involved until maintenance is

assumed after the two-year warranty period.



Legal Considerations: In Accordance with Section 18-3 of the Columbus Code,

all dedicated right-of-way must be accepted by Council.



Recommendations/ Actions: Approve the Resolution accepting a deed to that

portion of Westwind Drive and that portion of Windward Drive located in Section

Five Crosswinds







A RESOLUTION

NO. _____

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A DEED TO THAT PORTION OF WESTWIND

DRIVE AND THAT PORTION OF WINDWARD DRIVE LOCATED IN SECTION FIVE, CROSSWINDS ON

BEHALF OF COLUMBUS, GEORGIA.

WHEREAS, Columbus, Georgia has been submitted a deed conveying that portion of

Westwind Drive and that portion of Windward Drive located in Section Five,

Crosswinds, a full description of property on said deed; and,

WHEREAS, said streets have been improved and meets the required specifications

for acceptance by the City; and,

WHEREAS, the Engineering Department has inspected said streets and recommends

acceptance of same.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That certain deed dated September 3, 2010, conveying Columbus, Georgia

that portion of Westwind Drive and that portion of Windward Drive located in

Section Five, Crosswinds be and the same is hereby accepted. The Clerk of

Council is hereby authorized to have said deed recorded in the Deed Records in

the Office of the Superior Court of Muscogee County, Georgia. A copy of the

deed is hereto attached and by this reference made a part of this resolution.
