SUBJECT: Abandonment of a Portion of Drainage and Utility Easement
located in the rear portion of 1008 Eden Street

Recommendation: Approval is requested to execute a Quit Claim Deed to Mike
Massey for abandonment of a three (3) foot wide section along the northern edge
of the existing ten (10) foot drainage and utility easement of Lot 39, Block
"P" Meadow Run Subdivision.
Background: Mike Massey, owner of Lot 39, Block "P" Meadow Run Subdivision
(1008 Eden St) submitted a request for a building permit to the Inspection and
Codes Department at which time he found out that the structure he made
application to have built fell three (3) feet into a drainage and utility
easement. All known utilities have be contacted and agree to the abandonment of
no more than three (3) feet of the existing drainage and utility easement.
Analysis: Mike Massey, owner of Lot 39, Block "P" Meadow Run Subdivision (1008
Eden St) submitted a request to the Engineering Department requesting a portion
of the existing Drainage and Utility Easement be abandoned in order to
construct a 18' x 30' metal structure on a concrete slab at the rear of his
property. After checking with the utility companies, it is in agreement that a
three (3) foot wide section along the northern edge of the of the existing ten
(10) foot drainage and utility easement can be abandon. Diverspower agreed to
only relinquish the (3) foot wide section leaving the remainder (7) foot on Lot
39, Block "P". We have found no present or future use of that portion of the
existing easement. The remainders of all utility easements of record remain in
effect and providing appropriate width as required by the applicable utility
companies will be required for unknown utilities, repealing any conflicting
ordinances, and for other purposes.

Legal Considerations: The Council must approve the action by resolution
Recommendations/ Actions: Authorizing the City Manager to execute the Quit
Claim Deed to Mike Massey for abandonment of a three (3) foot wide section
along the northern edge of the existing ten (10) foot drainage and utility
easement of Lot 39, Block "P" Meadow Run Subdivision in order to construct a
18' x 30' metal structure.

A RESOLUTION AUTHORIZING THE CITY MANAGER OF COLUMBUS, GEORGIA TO EXECUTE A
QUIT CLAIM DEED TO MIKE MASSEY FOR A PORTION OF THE EXISTING DRAINAGE AND
UTILITY EASEMENT AS SHOWN LOCATED AT 1008 EDEN STREET ON THE PLAT ENTITLED LOT
39, BLOCK "P" MEADOW RUN SUBDIVISION.
WHEREAS, a three (3) foot wide section along the northern edge of the existing
ten (10) foot drainage and utility easement of Lot 39, Block "P" Meadow Run
Subdivision (1008 Eden Street) was requested to be abandon in order to
construct a 18' by 30' metal structure on a concrete slab; and,
WHEREAS, the aforementioned portion of the existing drainage and utility
easement is no longer in use and has been formally abandoned by all parties
concerned; and,
WHEREAS, Columbus, Georgia has no other use for the aforementioned portion of
the drainage and utility easement. The remainders of all drainage and utility
easements of record remain in effect and providing appropriate width as
required by the applicable utility companies will be required for unknown
utilities, repealing any conflicting ordinances, and for other purposes.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That, the City Manager is hereby authorized to execute a quit claim
deed to Mike Massey for a three (3) foot wide section along the northern edge
of the existing ten (10) foot drainage and utility easement of Lot 39, Block
"P" Meadow Run Subdivision (1008 Eden Street).

Introduced at a regular meeting of the Council of Columbus, Georgia, held
