Planning Advisory Commission's Recommendation: Conditional Approval based on the fact that the

request is compatible with existing land uses. The recommended amended

conditions are:

4. The western property lines shall meet the requirements of Category C, Option

3 of the Buffer Ordinance.

5. The northern property lines shall meet the requirements of Category C,

Option 1 of the Buffer Ordinance.



Planning Departments Recommendation: Conditional Approval based on the fact that the request is

compatible with existing land uses and consistent with future land uses of the

2028 Comprehensive Plan. The Planning Department recommends the same

conditions as those recommended by the Planning Advisory Commission.

area. The developer will need an approved drainage plan prior to issuance of a

Traffic Impact: This rezoning request does not anticipate generating a negative impact

on the transportation network.



This site shall meet the Codes and regulations of the Columbus Consolidated

Government for commercial usage.

Buffer Requiremnts

The site shall include a Category C buffer along all property lines bordered by

the SFR2 zoning districts. The 3 options under Category C are:

1) 20 feet with a certain amount of canopy trees, under story trees, and shrubs

/ ornamental grasses per 100 linear feet.

2) 10 feet with a certain amount of shrubs / ornamental grasses per 100 linear

feet and a wood fence or masonry wall.

3) 30 feet undisturbed natural buffer.



Attitude of Property Owners: Fifty (50) property owners within 300 feet of the subject

properties were notified of the rezoning request. The Planning Department has

not received any comments in regards to this case.



Additional Information: These properties were rezoned from SFR2 (R-1) to GC with conditions

back in 2003. Conditions could be found in Ordinance # 03-101 (enclosed).



The applicant is requesting to slightly change condition four (4) that

currently reads as follows: The western and northern property lines shall meet

the requirements of Category C, Option 3 of the Buffer Ordinance. He wants it

to be replaced for: The western property lines shall meet the requirements of

Category C, Option 3 of the Buffer Ordinance.



The applicant wants to add a fifth condition to address the buffer requirement

in the northern property line as follows: The northern property lines shall

meet the requirements of Category C, Option 1 of the Buffer Ordinance.



The reason for this request is that when this property was rezoned, St. Mary's

was a two lane highway, the decal lane was not required by the City's Traffic

Department, and the detention pond requirements for a single development were

not in place. Also, the property lacks of depth needed to provide the required

buffer (option 3).
