SUBJECT: Acceptance of a Deed for Additional Right-Of-Way adjacent to
Levy Road at South Lumpkin Road
INITIATED BY: Engineering
Recommendation: Approval is requested to accept a deed to that portion of Part
of Land Lot 9, 7th District 0.014 Acres Adjacent to Levy Road. The Department
of Engineering has inspected this street and recommends the acceptance.
Background: The CVS development, 6622 South Lumpkin Road, at the intersection
of South Lumpkin Road and Levy Road was required to construct a public sidewalk
along both sides of this development in accordance with the UDO. The
construction of a required decel lane along Levy Road placed the new sidewalk
off public right-of-way.
Analysis: The developer desires to deed a portion of this property to the City
as street right-of-way to provide continuity for the pedestrian sidewalk. This
will also allow the City to maintain the new sidewalk as it does the remaining
sidewalk that is constructed on the right-of-way. A deed has been conveyed to
the City conveying a section of right-of-way, Part of Land Lot 9, 7th District
having an area of 0.014 acres adjacent to Levy Road.
Financial Considerations: The sidewalk and property conveyance will include a
two-year maintenance agreement.
Legal Considerations: In Accordance with Section 18-3 of the Columbus Code,
all dedicated right-of-ways must be accepted by written resolution of Council.
Recommendations/ Actions: Approve the Resolution accepting a deed to Part of
Land Lot 9, 7th District 0.014 Acres Adjacent to Levy Road.

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A DEED TO PART OF LAND LOT 9, 7TH
DISTRICT 0.014 ACRES ALONG LEVY ROAD, OF THE CVS DEVELOPMENT FOR THE PURPOSE OF
INCORPORATING THE SIDEWALK INTO THE STREET RIGHT-OF-WAY, ON BEHALF OF COLUMBUS,
GEORGIA.
WHEREAS, CVS Development at 6622 South Lumpkin Road constructed commercial
driveways, decel lanes and sidewalks in accordance with the UDO; and,
WHEREAS, the installation of the decel lane caused the sidewalk long Levy Road
to encroach into the private property of CVS at 6622 South Lumpkin Road; and,
WHEREAS, CVS desires to deed 0.014 acres to the City for the purpose of
incorporating the sidewalk into the street right-of-way; and,
WHEREAS, the Engineering Department has inspected the sidewalk and recommends
acceptance of same.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That certain deed dated March 19, 2010, conveying to Columbus, Georgia
Part of Land Lot 9, 7th District 00.014 acres along Levy Road be and the same
is hereby accepted. The Clerk of Council is hereby authorized to have said deed
recorded in the Deed Records in the Office of the Superior Court of Muscogee
County, Georgia. A copy of the deed is hereto attached and by this reference
made a part of this resolution.
