SUBJECT: Acquisition of Right of Way - Muscogee Technology Park Project
(Schatulga Rd./Eastern Conn. from Buena Vista Rd. to south of
Chattsworth Rd.)
INITIATED BY: Department of Planning
Recommendation: Approval is requested to execute a Contract for Acquisition of
Right of Way, Federal-Aid Project (Non-Reimbursable) for Muscogee Technology
Park Project (Eastern Connector) with the Georgia Department of Transportation
(D.O.T.) for the construction and widening of a New Road (Schatulga Rd./Eastern
Conn. from Buena Vista Rd. to south of Chattsworth Rd.) , Project
STP00-8042-00(006), Muscogee County, Georgia .
Background: The DOT and the Consolidated Government of Columbus, Georgia (the
City) propose the construction and widening of a New Road (Schatulga
Rd./Eastern Conn. from Buena Vista Rd. to south of Chattsworth Rd.) that will
make connection to and from the Muscogee Technology Park (Eastern Connector) to
SR22/US80/Macon Road. The City is responsible for the acquisition of Right of
Way and will not be reimbursed by GA DOT.
Analysis: The attached agreement is made and entered into by and between the
DOT and the City for the purpose of the City to acquire Right of Way on the
parcels along said Project.
Financial Considerations: Funding for said project will be funded under the
Need for Land (NFL) Improvement account.
Legal Considerations: The City Attorney disagrees with the Indemnification
paragraph but to participate in the program the City has to agree to such, as
does every other government entity in the state.
Recommendations/ Actions: Approve the Resolution authorizing the execution of
the Contract for Acquisition of Right of Way, Federal-Aid Project
(Non-Reimbursable) for Muscogee Technology Park Project and subsequent
agreements necessary to implement the project with the Georgia Department of
Transportation for the construction and widening of a New Road (Schatulga
Rd./Eastern Conn. from Buena Vista Rd. to south of Chattsworth Rd.), Project

A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR
ACQUISITION OF RIGHT OF WAY, FEDERAL-AID PROJECT (NON-REIMBURSABLE) FOR
MUSCOGEE TECHNOLOGY PARK (EASTERN CONNECTOR) WITH THE GEORGIA DEPARTMENT OF
TRANSPORTATION FOR THE CONSTRUCTION AND WIDEN OF A NEW ROAD (SCHATULGA
RD./EASTERN CONN. FROM BUENA VISTA RD. TO SOUTH OF CHATTSWORTH RD.); PROJECT
NO. STP00-8042-00(006), MUSCOGEE COUNTY,GEORGIA.
WHEREAS, this agreement is made and entered into by and between the
Department of Transportation and the Consolidated Government of Columbus,
Georgia; and,
WHEREAS, the Department of Transportation and the City propose to let
for construction of the above indicated project; and,
WHEREAS, the City is required to acquire Right of Way on above mentioned
project and will not be reimbursed by GA DOT; and,
WHEREAS, the funding will be available under the Need for Land (NFL)
Improvement account; and,
WHEREAS, all procedures and policies depicted in the attached Contract
will be adhered to.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS
FOLLOWS:
That the Mayor is hereby authorized to execute a Contract for
Acquisition of Right of Way, Federal-Aid Project (Non-Reimbursable) for
Muscogee Technology Park Project (Schatulga Rd./Eastern Conn. from Buena Vista
Rd. to south of Chattsworth Rd.) and subsequent agreements necessary to
implement the project with the Georgia Department of Transportation for the
construction and widening of above referenced project, Project No.
STP00-8042-00(006), Muscogee County, Georgia
