SUBJECT: Pastoral Institute, Right-of-way Encroachment
INITIATED BY: Engineering Department
Recommendation: Approve the attached Resolution authorizing a permanent
encroachment for ten Monitoring Wells that were installed as part of the
Pastoral Institute's expansion project along the east right-of-way of 15th
Avenue north of 20th Street.
Background: The Pastoral Institute located at 2022 - 15th Avenue is
performing both renovations and a campus expansion project. Part of this work
is using a subsurface geothermal well field to reduce HVAC costs. The
contractor that installed the geothermal wells drilled ten of the wells on City
right-of-way in the vicinity of the new sidewalk along the east side of 15th
Avenue north of 20th Street. The Pastoral Institute met with the City's
Engineering staff to request that they be allowed to remain as a permanent
encroachment. A drawing of the well locations is attached.
Analysis: The Engineering Department inspected the well locations finding they
do not appear to conflict with any existing utilities or other right-of-way
features. The Engineering Department recommends approval of a permanent
encroachment permit with the following conditions;
1. All wells shall be marked with "Monitoring Well Marker caps" to notify any
future utility work of their location.
2. The Pastoral Institute shall remove the Monitoring Wells at no cost to the
City should the City ever need the use of this right-of-way.
3. The Pastoral Institute shall hold the City harmless from any liability or
damage issues arising from the wells existence on City right-of-way.
Financial Considerations: The City will not incur any costs with the approval
of this encroachment.
Legal Considerations: A Council approved resolution is needed authorizing the
conditions placed on this permanent right-of-way encroachment.
Recommendations/ Actions: Recommend approving the attached Resolution
authorizing this permanent encroachment.

A RESOLUTION AUTHORIZING THE ENGINEERING DEPARTMENT TO ISSUE A PERMIT FOR A
PERMANENT ENCROACHMENT OF TEN MONITORING WELLS INSTALLED ALONG THE EAST SIDE OF
15TH AVENUE NORTH OF 20TH STREET FOR THE PASTORAL INSTITUTE, 2022 - 15TH AVENUE
WITH THE FOLLOWING CONDITIONS: (1) ALL WELLS SHALL DISPLAY A "MONITORING WELL"
MARKER CAP TO NOTIFY ANY FUTURE CONSTRUCTION WORK OF THEIR LOCATIONS; (2) THE
PASTORAL INSTITUTE SHALL REMOVE ANY OR ALL MONITORING WELLS AT NO COST TO THE
CITY SHOULD THE CITY NEED THE USE OF THIS RIGHT-OF-WAY IN THE FUTURE; AND (3)
THE PASTORAL INSTITUTE SHALL HOLD THE CITY HARMLESS FROM ANY LIABILITY OR
DAMAGE ISSUES ARISING FROM THE WELLS EXISTENCE IN THE CITY'S RIGHT-OF-WAY.
WHEREAS, the Pastoral Institute is conducting renovations and building
expansion as part of construction project; and,
WHEREAS, this construction project uses a geothermal well field to reduce HVAC
costs during which time a contractor inadvertently drilled ten of the wells on
15th Avenue right-of-way; and,
WHEREAS, the Engineering Department inspected the well locations finding that
they do not appear to create any conflicts recommending approval of a permanent
encroachment with conditions described here within.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
THAT THE ENGINEERING DEPARTMENT IS HEREBY AUTHORIZED TO ISSUE A PERMIT
FOR A PERMANENT ENCROACHMENT OF TEN MONITORING WELLS INSTALLED ALONG THE EAST
SIDE OF 15TH AVENUE NORTH OF 20TH STREET FOR THE PASTORAL INSTITUTE, 2022 -
15TH AVENUE WITH THE FOLLOWING CONDITIONS: (1) ALL WELLS SHALL DISPLAY A
"MONITORING WELL" MARKER CAP TO NOTIFY ANY FUTURE CONSTRUCTION WORK OF THEIR
LOCATIONS; (2) THE PASTORAL INSTITUTE SHALL REMOVE ANY OR ALL MONITORING WELLS
AT NO COST TO THE CITY SHOULD THE CITY NEED THE USE OF THIS RIGHT-OF-WAY IN THE
FUTURE; AND (3) THE PASTORAL INSTITUTE SHALL HOLD THE CITY HARMLESS FROM ANY
