An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changing certain boundaries of a district

located at 1617 & 1619 12th Avenue from RMF2 (Residential Multi-Family 2)

District to GC (General Commercial) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Department is, and the

same is hereby amended by changing the following described properties from RMF2

(Residential Multi-Family 2) District to GC (General Commercial) District:

PARCEL ONE:

All that tract or parcel of land situate, lying and being in the State of

Georgia, County of Muscogee and City of Columbus, and being known and

designated as the SOUTHERLY PART OF LOT NUMBERED SIXTEEN (16), of the M. E.

GRAY SURVEY, as shown by a map or plat of said survey recorded in Deed Book

?CC?, Folio 151, in the office of the Clerk of the Superior Court of Muscogee

County, Georgia, and being more particularly described within the following

metes and bounds, to wit:

BEGINNING at an iron stake on the western line of 12th Avenue 239.59 feet,

south 01 degree 06 minutes east of the southwesterly corner of the intersection

of Linwood Boulevard and 12th Avenue and running thence south 01 degree 06

minutes east, along the western line of 12th Avenue, a distance of 47 feet to

an iron stake; thence running south 88 degrees 38 minutes west, a distance of

153.35 feet to an iron; thence running north 00 degrees 40 minutes west, a

distance of 47 feet to an iron; thence running north 88 degrees 38 minutes

east, a distance of 153 feet to the point of beginning of the tract or parcel

of land herein conveyed. The foregoing is the identical property conveyed to

W. V. Gore by Mrs. Virginia J. Desportes by warranty deed dated November 17,

1949, and recorded in the office of the aforementioned Clerk in Deed Book 321,

folio 374, and later conveyed by Gladys H. Gainey and Paul Gainey to Donald E.

Johnston and Theresa M. Johnston by warranty deed dated November 19, 1982, and

recorded in Deed Book 2148, folio 84, in the office of the aforementioned

Clerk. Located thereon is house numbered 1617 12th Avenue, according to the

present numbering of houses in Columbus, Georgia.

PARCEL TWO:

All that tract and parcel of land situate, lying and being in the State of

Georgia, County of Muscogee and City of Columbus, and being known and

designated as the SOUTHERLY PART OF LOT NUMBERED SIXTEEN (16), of the M. E.

GRAY SURVEY, as shown by a map or plat of said survey recorded in Deed Book

?CC?, Folio 151, in the office of the Clerk of the Superior Court of Muscogee

County, Georgia, and being more particularly described within the following

metes and bounds, to wit:

BEGINNING at the southwest intersection of 12th Avenue with 16th Street

(formerly known as Linwood Drive), the same being at the northeast corner of a

brick store building, and running thence south, along the western line of 12th

Avenue, a distance of 188 feet to a stob for the starting point of the property

herein conveyed, and thence running (from said stob), south, along the western

line of 12th Avenue, a distance of 49 ? feet to the northeast corner of the

land know or formerly owned by Skinner; running thence west, a distance of 155

feet, more or less, along the north numbered 16 and 17, a distance of 43 feet,

more or less, to the land now or formerly owned by Illges, and running thence

east, a distance of 155 feet, more or less, to the point of beginning on the

western line of 12th Avenue. Said property was conveyed by Paul Gainey and

Gladys H. Gainey to Donald E. Johnston and Theresa M. Johnston, by warranty

deed dated November 17, 1982, and recorded in Deed Book 2148, folio 90, in the

office of the aforementioned Clerk. Located thereon is house numbered 1619

(formerly 1539) 12th Avenue, according to the present numbering of houses in

Columbus, Georgia.

The above-described property is being rezoned with the following condition.

1. A variance to maintain zero lot line on 12th Avenue to be consistent with

current building site.

Introduced at a regular meeting of the Council of Columbus, Georgia held on the

28th day of April, 2015; introduced a second time at a regular meeting of said

Council held on the day of , 2015 and adopted at said meeting by

the affirmative vote of members of said Council.
