SUBJECT: Acquisition of Right of Way - Muscogee Technology Park Project

Recommendation: Approval is requested to execute a Contract for
Acquisition of Right of Way, Federal-Aid Project (Non-Reimbursable) for
Muscogee Technology Park Project (Eastern Connector) with the Georgia
Department of Transportation (D.O.T.) for the construction and widening of
Lynch Road from Chattsworth Road to SR 22/US 80/Macon Road, Project
CSSTP-0008-00(635), Muscogee County, Georgia .
Background: The DOT and the Consolidated Government of Columbus, Georgia
(the City) propose the construction and widening of Lynch Road that will make
connection to and from the Muscogee Technology Park (Eastern Connector) to
SR22/US80/Macon Road. The City is responsible for the acquisition of Right of
Way.
Analysis: The attached agreement is made and entered into by and between the
DOT and the City for the purpose of the City to acquire Right of Way on the
parcels along said Project.
Financial Considerations: Funding for said project will be funded under the
Need for Land (NFL) Improvement account.
Legal Considerations: The City Attorney disagrees with the Indemnification
paragraph but to participate in the program the City has to agree to such, as
does every other government entity in the state.
Recommendations/ Actions: Approve the Resolution authorizing the execution of
the Contract for Acquisition of Right of Way, Federal-Aid Project
(Non-Reimbursable) for Muscogee Technology Park Project (Eastern connector) and
subsequent agreements necessary to implement the project with the Georgia
Department of Transportation for the construction and widening of Lynch Road
from Chattsworth Road to SR22/US80/Macon Road, Project CSSTP-0008-00(635),
Muscogee County, Georgia.

A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR
ACQUISITION OF RIGHT OF WAY, FEDERAL-AID PROJECT (NON-REIMBURSABLE) FOR
MUSCOGEE TECHNOLOGY PARK (EASTERN CONNECTOR) WITH THE GEORGIA DEPARTMENT OF
TRANSPORTATION FOR THE CONSTRUCTION AND WIDEN OF LYNCH ROAD FROM CHATTSWORTH
ROAD TO SR22/US80/MACON ROAD; PROJECT NO. CSSTP-0008-00(635), MUSCOGEE COUNTY
GEORGIA.
WHEREAS, this agreement is made and entered into by and between the
Department of Transportation and the Consolidated Government of Columbus,
Georgia; and,
WHEREAS, the Department of Transportation and the City propose to let
for construction of the above indicated project on Lynch Road to the Muscogee
Technology Park (Eastern Connector); and,
WHEREAS, the City is required to acquire Right of Way on above
mentioned project; and,
WHEREAS, the funding will be available under the Need for Land (NFL)
Improvement account; and,
WHEREAS, all procedures and policies depicted in the attached Contract
will be adhered to.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS
FOLLOWS:
That the Mayor is hereby authorized to execute a Contract for
Acquisition of Right of Way, Federal-Aid Project (Non-Reimbursable) for
Muscogee Technology Park Project (Eastern Connector) and subsequent agreements
necessary to implement the project with the Georgia Department of
Transportation for the construction and widening of Lynch Road from Chattsworth
Road to SR22/US80/Macon Road, Project No. CSSTP-0008-00(635), Muscogee County,
Georgia
