SUBJECT: Abandonment of all easements located on Big Creek Drive Lot
45, Block "A" also known as 7891 Big Creek Drive located in Section Two,
Big Creek Subdivision
INITIATED BY: Engineering Department
Recommendation: Approval is requested to execute a Quit Claim Deed to James and
Peggy Salie for abandonment of a ten foot drainage and utility easement located
on the rear portion and the entire Storm Sewer Easement running along the
eastern property line of Lot 45, Block "A" also known as 7891 Big Creek Drive
on Big Creek Drive in Section Two Big Creek Subdivision to construct a storage
building.
Background: Homeowners James and Peggy Salie have submitted a request to the
Engineering Department that all easements located on their property at Big
Creek Drive Lot 45, Block "A" also know as 7891 Big Creek Drive, located in
Section Two Big Creek Subdivision, be abandoned in order to construct a storage
building at the rear of their property. All known utilities have been contacted
and agree to the abandonment of a ten foot drainage easement located on the
rear portion and the entire Storm Sewer Easement running along the eastern
property line of Lot 45, Block "A" on Big Creek Drive in Section Two Big Creek
Subdivision as shown on the highlighted plat.
Analysis: Homeowners James and Peggy Salie have submitted a request to the
Engineering Department that all easements located on their property at Big
Creek Drive Lot 45, Block "A" also know as 7891 Big Creek Drive, located in
Section Two Big Creek Subdivision, be abandoned in order to construct a storage
building at the rear of their property. After checking with the utility
companies, it is in agreement that the ten (10) foot drainage and utility
easement that is located on the rear portion. The Rainwater Management Division
checked and has found no present or future use of the entire Storm Sewer
Easement (noted as being a private drainage system) along the eastern property
line of Lot 45, Block "A" located on Big Creek Drive and within Section Two,
Big Creek Subdivision. The remainders of all utility easements of record in
effect and providing appropriate width as required by the applicable utility
companies will be required for unknown utilities, repealing any conflicting
ordinances, and for other purposes.

Legal Considerations: The Council must approve the action by resolution.

A RESOLUTION AUTHORIZING THE CITY MANAGER OF COLUMBUS GEORGIA TO
EXECUTE A QUIT CLAIM DEED TO JAMES AND PEGGY SALIE FOR THE TEN (10) FOOT
DRAINAGE AND UTILITY EASEMENT LOCATED ON THE REAR PORTION AND THE ENTIRE STORM
SEWER EASEMENT RUNNING ALONG THE EASTERN PROPERTY LINE OF LOT 45, BLOCK "A",
ALSO KNOWN AS 7891 BIG CREEK DRIVE, LOCATED IN SECTION TWO, BIG CREEK
SUBDIVISION LYING IN LAND LOTS 60 & 61, 8TH DISTRICT.
WHEREAS, the ten (10) foot drainage and utility easement along the rear
property of 45, Block "A" also known as 7891 Big Creek Drive, located in
Section Two, Big Creek Subdivision was requested to be abandoned; and,
WHEREAS, the entire storm sewer easement along the eastern property
line of 45, Block "A" also known as 7891 Big Creek Drive, located in Section
Two, Big Creek Subdivision was requested to be abandon in order to construct a
storage building at the rear of their property; and,
WHEREAS, the aforementioned existing drainage and utility and the storm
sewer easements are no longer in use and have been formally abandoned by all
parties concerned; and,
WHEREAS, Columbus, Georgia has no other use for the aforementioned
existing drainage, utility and storm sewer easements. The remainders of all
drainage and utility easements of record remain in effect and providing
appropriate width as required by the applicable utility companies will be
required for unknown utilities, repealing any conflicting ordinances, and for
other purposes.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS
FOLLOWS:
That, the City Manager is hereby authorized to execute a quit claim
deed to James and Peggy Salie for a ten (10) foot drainage and utility easement
along the rear property and the entire storm sewer easement long the eastern
property line of 45, Block "A" also known as 7891 Big Creek Drive, located in
Section Two, Big Creek Subdivision. The remainders of all drainage, utility and
storm sewer easements of record remain in effect and providing appropriate
width as required by the applicable utility companies will be required for
unknown utilities, repealing any conflicting ordinances, and for other
purposes.
