SUBJECT: Termination of Joint Purchase Agreement
INITIATED BY: Department of Community Reinvestment
Recommendation: Approval is requested to amend Resolution # 6-07 to terminate
the Joint Purchase Agreement between Woodmont Properties, LLC. and the City of
Columbus to acquire property at 3601 Ginger Drive.
Background: Resolution 6-07 authorized the City Manager to enter into a Joint
Purchase Agreement with Woodmont Properties, LLC to acquire 12.874 +/- acres at
3601 Ginger Drive. The property is to be used for a drainage project on
Effingham Way and Ginger Drive. The agreement allowed, upon completion of the
drainage project, for the purchase of the unused property from the drainage
project to be purchased by Woodmont Properties, Inc. for $250,000. The
original budget for the drainage project was $2.5 million. The contracted cost
of the drainage project is $1,723,679.
Analysis: With the cost of the drainage project coming in under budget, it
was determined that the sale of the unused portion of the property was not
necessary. As per the Joint Purchase Agreement (Section 12), the City will
return the $250,000 Letter of Credit to Woodmont Properties, Inc. and terminate
the agreement. The termination of this agreement will not have an effect on
the drainage project. Upon completion of the of the drainage project, the
unused portion of the property will be returned to an undistributed natural
area
Financial Considerations: The City of Columbus will incur the total $600,000
cost of the purchase of the property.
Legal Considerations: Council must approve the purchase and the exchange of
property.
Recommendations: Approve the resolution terminating the Joint Purchase
Agreement between Woodmont Properties, Inc. and the City of Columbus to acquire
property at 3601 Ginger Drive.

A RESOLUTION AUTHORIZING TO AMEND RESOLUTION #6-07 TO TERMINATE THE
JOINT PURCHASE AGREEMENT BETWEEN WOODMONT PROPERTIES, LLC. AND THE CITY OF
COLUMBUS TO ACQUIRE PROPERTY AT 3601 GINGER DRIVE.
WHEREAS, Resolution 6-07 authorized the City Manager to enter into a Joint
Purchase Agreement with Woodmont Properties, LLC to acquire 12.874 +/- acres at
3601 Ginger Drive; and,
WHEREAS, the drainage project costs will be $1,723,689; and,
WHEREAS, due to the bid amount for the drainage project, the sale of the unused
portion of the property is no longer necessary to fund the project; and,
WHEREAS, the City will return the $250,000 Letter of Credit to Woodmont
Properties, LLC; and,
WHEREAS, the termination of the Joint Purchase Agreement will not have an
effect on the drainage project on Effingham Way and Ginger Drive; and,
WHEREAS, upon completion of the drainage project, the unused portion of the
property will be returned to an undistributed natural area; and,
WHEREAS, it is in the best interest of the City to terminate the Joint Purchase
Agreement.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
1. That Resolution #6-07 is hereby amended; and,
2. That the City Manager is hereby authorized to terminate the Joint Purchase
Agreement with Woodmont Properties, LLC.
