SUBJECT: Condemnation on Corporate Ridge/Woodruff Farm (Parcel 3)



INITIATED BY: Felton G. Grant, Right of Way Acquisition Coordinator,

Recommendation: Approval is requested for the acquisition of Parcel 3, Tax Map

# 097-045-001, Corporate Ridge Parkway (map attached) for the Intersection

Improvement of Corporate Ridge Parkway @ Woodruff Farm Road Project No.

PRC10-S011-00(685) totaling 0.061 +/- acres of Permanent Construction Easement

and 0.097 +/- acres of Temporary Construction Easement, to also include a

Driveway easement. for County Road and/or Municipal Street purposes, and

authorizing the filing of a Declaration of Taking by the City Attorney or his

representatives for the acquisition of said land under the authority of the

official code of Georgia annotated, Section 32-3-1 et.seq for the Corporate

Ridge Parkway @ Woodruff Farm Road Intersection SO11685, Project No.

PRC10-SO11-00(685), Muscogee County.



Background: The parcel is one of three on this project and this project is the

3rd of three projects that were involved in the agreement of the previous

Governor to assist in upgrading the traffic flow in the Corporate Ridge area.



Analysis: To keep the project on schedule, it was determined by the Legal

Counsel of the Development Authority and the Legal Counsel of the City to

proceed with condemnation because of multiple entities with interest that would

be difficult to obtain releases within a reasonable time. It is necessary to

proceed and to pay the money into Court, thereby taking position of the

property allowing the City to proceed with the project. it is necessary to

Financial Considerations: This project is funded by the CIP Funds.



Projected Annual Fiscal Impact Statement: There will be no Projected Annual

Fiscal Impact except for cost of Condemnation expense. Should not exceed

$5,000.00.



Legal Considerations: The City Attorney agrees to this action.



Recommendations/ Actions: Authorizing the City Manager to order the

Acquisition of said land for County Road and/or Municipal Street purpose, and

authorizing the filing of a Declaration of Taking by the City Attorney or his

representatives for the acquisition of said land under authority of the

official code of Georgia annotated, Section 32-3-1 et-seq. for the Corporate

Ridge @ Woodruff Farm Road Intersection SO11685, Project No.

PRC10-SO11-00(685), Muscogee County.

A RESOLUTION DECLARING THAT THERE IS A NEED AND NECESSITY TO IMMEDIATELY

ACQUIRE EASEMENTS TO LANDS UNDER THE PROVISION OF THE OFFICIAL CODE OF GEORGIA

ANNOTATED, AUTHORIZING THE MAYOR TO ORDER THE ACQUISITION OF SAID EASEMENTS FOR

COUNTY ROAD AND/OR MUNICIPAL STREET PURPOSES, AND AUTHORIZING THE FILING OF A

DECLARATION OF TAKING BY THE CITY ATTORNEY OR HIS REPRESENTATIVES FOR THE

ACQUISITION OF SAID EASEMENTS UNDER THE AUTHORITY OF THE OFFICIAL CODE OF

GEORGIA ANNOTATED, SECTION 32-3-1, ET. SEQ.



WHEREAS, it is hereby determined that the circumstances in connection

with acquiring easements for the Corporate Ridge Parkway at Woodruff Farm Road

(PRC10-S011-00(685)) are such that it is necessary to immediately acquire

easements in the following described property, to-wit:

All that tract or parcel of land lying and being in Land Lot 25 of the 9th Land

District and/or N/A Georgia Militia District of Muscogee County, Georgia, and

beginning at a point 58.65 feet left of and opposite Station 18+69.00 on the

construction centerline of CORPORATE RIDGE PARKWAY on Georgia Highway Project

No. PRC10-S011-00(685); running thence northwesterly 70.394 feet along the arc

of a curve (said curve having a radius of 869.150 feet and a chord distance of

70.374 feet on a bearing of N 44o02'18" W) to the point 56.84 feet left of and

opposite station 17+95.81 on said construction centerline laid out for

CORPORATE RIDGE PARKWAY; thence N 41o43'04" W a distance of 32.81 feet to a

point 56.91 feet left of and opposite station 17+63.00 on said construction

centerline laid out for CORPORATE RIDGE PARKWAY; thence N 48o09'25" E a

distance of 28.09 feet to a point 85.00 feet left of and opposite station

36.320 feet on a bearing of N 71o17'23" W) to the point 56.49 feet left of and

opposite station 22+58.00 on said construction centerline laid out for

CORPORATE RIDGE PARKWAY; thence N 17o30'30" E a distance of 19.51 feet to a

point 76.00 feet left of and opposite station 22+58.00 on said construction

centerline laid out for CORPORATE RIDGE PARKWAY; thence S 73o53'18" E a

distance of 35.29 feet to a point 76.00 feet left of and opposite station

Containing 0.097 acres more or less.



Said latter temporary easement for the construction of slopes, only, will

expire upon completion and final acceptance of said project by the Columbus

Consolidated Government.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS

FOLLOWS:



1. That there is a necessity for the immediate acquisition of said property

interests under the provisions of the Official Code of Georgia Annotated

?32-3-1, et. seq.



2. That the Mayor of Columbus, Georgia be, and she hereby is, authorized to

issue such orders and file such papers in the courts and enter into such

agreements as she deems necessary for the immediate acquisition of said

property interests by condemnation under the provisions of said Act.



3. That the immediate acquisition of such property interests is for county

roads, municipal streets or public highway purposes.



4. That, in accordance with an investigation and report made to Columbus,

Georgia by a competent land appraiser, the estimated value of $1,500.00 is just

and adequate compensation to be paid for such acquisitions, and is hereby

determined and approved, with such sum being authorized to be paid into Court

for the use of the persons entitled thereto.



5. That the Mayor, City Manager and City Attorney, or their representatives,

are hereby authorized to take any and all lawful actions that they may deem

needful, necessary, advisable, or proper for the immediate acquisition of said

property interests pursuant to and in accordance with the provisions of the

Official Code of Georgia Annotated ?32-3-1, et. seq.
