PLANNING ADVISORY COMMISSION MEETING

February 15, 2006



A meeting of the Planning Advisory Commission was held Wednesday, February 15,

2006 in the Council Chambers on the Plaza Level of the Government Center.



Commissioners Present: Chairperson Derrick Shields, Vice-Chairperson Mullin,

Brad Dodds, Bob Crane and Michael Eddings.



Staff Members: Will Johnson, Zoning Administrator and Tina Trant, Recorder.



Commissioners Absent: Chris Henson, Joe Alexander, Berry Henderson and Karl

Douglass.



Others Present: Nimesh Desai, Stephen Ginn, Paul Snellings, M. Moore, Jerry

Washington, Julia Lewis.



I. CALL TO ORDER: Chairperson Shields called the meeting to order at 9:00

a.m. He explained the rezoning process to the audience. Commissioner Eddings

will be voting for Commissioner Alexander who is absent.



II. APPROVAL OF MINUTES: None available.



III. SPECIAL EXCEPTION CASES: None





IV. REZONING CASES:



1. ZC0601-3: A request to rezone the property located at the southeast corner

of Moye Road and Buena Vista Road. The current zoning is Single Family

Residential 2. The proposed zoning is residential Multi Family 2, General

Commercial and Neighborhood Commercial. The property will be used for

commercial and apartments. Stephen Ginn is the applicant.



Mr. Will Johnson read the Staff Report for this case. This case is

inconsistent with the Future Land Use Map of the Comprehensive Plan for

Planning District 11. The Land Use Designation shows Low Density Residential.



Policy Statements are not addressed.



It is compatible with existing land uses.



The property does not lie within a studied floodplain and floodway area. The

developer will need an

approved drainage plan prior to issuance of a Site Development Permit.



The property is served by all city services.



The proposed project is not expected to have a negative impact on the

transportation network.



The site shall meet the codes and regulations of the Columbus Consolidated

Government for commercial usage.



This development could have a maximum of 5-10 children of various ages.

Elementary age students would attend Georgetown Elementary, which has 512

students, capacity 500. Middle school age students would attend East Columbus

Middle School, which has 664 students, capacity 675. High school age students

would attend Kendrick which has 1,127 students, capacity 1,350.



The proposed NC portions of the development shall have a Category C buffer

requirement along all property lines bordered by the SFR2 and proposed RMF2

zoning districts. The three options under Category C are: 1. 20 feet with a

certain amount of canopy trees, understory trees, and shrubs / ornamental

grasses per 100 linear feet 2. 10 feet with a certain amount of shrubs /

ornamental grasses per 100 linear feet and a wood fence or masonry wall 3. 30

feet undisturbed natural buffer.



The proposed RMF2 development shall have a Category B buffer requirement along

all property lines bordered by the SFR2 zoning district. The three options

under Category B are: 1. 15 feet with a certain amount of canopy trees,

understory trees, and shrubs / ornamental grasses per 100 linear feet 2. 10

feet with a certain amount of understory trees and shrubs / ormamental grasses

per 100 linear feet and a wood fence or masonry wall 3. 20 feet undisturbed

natural buffer.



Fort Benning Recommendation: Under review.



DRI Recommendation: None.



Twenty-seven (27) property owners within 300 feet were notified of this

rezoning request. The Planning

Department received two comments opposing this rezoning request.



Conditions needed: Deceleration lanes shall be required as determined by the

City Traffic Engineer.



There is no additional information.



Stephen Ginn, applicant, came to the podium. He wants to put in apartments,

there will be 7 buildings, a total of 120 units.



Paul Snellings, came to the podium. He is Mr. Ginn?s partner. On the corner

of Moye and Buena Vista will be commercial, maybe a gas station, convenience

store. They want to build apartments for the new military personnel coming to

Fort Benning.



Gerald Washington, 5983 Walters Loop, came to the podium. He has lived in his

house one year. The developer couldn?t put a sign in his neighborhood because

the street is too narrow. He is opposed to the rezoning because of traffic

congestion and overcrowded schools. If anything is built in the area it should

be houses comparable to his house, $200,000 or more.



James Webb, 6047 Walters Loop, came to the podium. He does not want any

apartments/gas station built in this area. It will bring in an unwanted

element. He was also concerned about how far the convenience store would be

from his subdivision.



Chairperson Shields asked for discussion and a motion. Commissioner Crane made

a motion to approve the rezoning case based on the fact that it is compatible

with existing land uses, it is not in a flood zone, will not impact traffic, it

will met the codes and regulations for traffic engineering, there is a buffer

requirement. Commissioner Eddings seconded. The case was unanimously

approved.



2. ZC0601-7: A request to rezone the property located at 4134 Victory Drive.

The current zoning is Neighborhood Commercial. The proposed zoning is General

Commercial. The property will be used for a convenience store with gas sales.

Nimesh Desai is the applicant.



Mr. Will Johnson read the Staff Report for this case. This case is consistent

with the Comprehensive Plan for Planning District 12. The Land Use Designation

shows General Commercial.



Policy Statements are not addressed.



It is compatible with existing land uses.



The property does lie within a floodplain and floodway area. The developer

will need an

approved drainage plan prior to issuance of a Site Development Permit.



The property is served by all city services.



The proposed project is not expected to have a negative impact on the

transportation network.



The site shall meet the codes and regulations of the Columbus Consolidated

Government for commercial usage.



There is no school impact.



There is no buffer requirement.



Fort Benning Recommendation: None



DRI Recommendation: None.



Fourteen (14) property owners within 300 feet were notified of this rezoning

request. The Planning

Department did not receive any comments concerning this rezoning request.



There are no conditions.



There is no additional information.



Nimesh Desai, applicant, came to the podium. He wants to use this property for

a convenience store with gas sales. Commissioner Crane made a motion to

approve this rezoning request based on the facts that it is consistent with

future land use map, the property does not lie with in a floodway, it will meet

all codes and regulations of the Columbus Consolidated Government.

Commissioner Eddings seconded. It was approved unanimously.
