REGULAR MEETING - 2:00 P.M. ? NOVEMBER 7, 2007





The Regular Meeting of the Board of Zoning Appeals was held Wednesday, November

7, 2007 at 2:00 P.M., on the 1st Floor of the Government Center Annex in the

conference room, 420-10th Street. Mr. Billy Edwards, Board Chairman, called

the meeting to order. The board members present were:





Mr. Perry Borom

Mr. Wright Wade







Also present representing the Inspections and Code Enforcement Department was

Mr. Danny Cargill, Secretary of the Board, Mrs. Millicent Burden, Recording

Secretary.





CASE NO. 07-V093?GRANTED

John Dorsey III, 5754 Germantown Road, to reduce the rear setback requirement

from 30 ft to 21 ft for an addition. The property is zoned SFR2.



Mr. Dorsey stated that he wanted to put a cover over an existing slab, which is

an extended driveway. The roof will match with the existing materials with

shingles.



Mr. Edward Mitchell came forth in opposition to this appeal. He stated that

the majority of Mr. Dorsey?s backyard is concrete which causes a drainage

problem in his yard. Somehow, the flow to the creek has been blocked by a

fence, which creates a backup. Mr. Dorsey offered to open up the fence to

unblock the flow.



Mr. Borom made a motion to grant this appeal. Mr. Wade seconded the motion.

Motion carried unanimously.





CASE NO. 07-V094--GRANTED

Dana Weiler, 6554 Patriot Drive, to reduce the rear yard setback requirement

from 30 ft to 23 ft for an addition. The property is zoned SFR3.



Mrs. Weiler stated that she is adding an extension to her sunroom and adding on

to the rear of the house. The roofline will be rebuilt so the water will go

down both sides from the rear. She will add french drains and the materials

will match the existing materials.



There was no opposition present for this appeal.



Mr. Wade made a motion to grant this appeal. Mr. Borom seconded the motion.

Motion carried unanimously.





CASE NO. 07-V095?TABLED

Action Buildings, 3069 Viking Drive, to reduce the side yard setback

requirement from 5 ft to 2 ft for an attached carport. The property is zoned

SFR3.



Mr. Borom made a motion to grant this appeal. Mr. Wade seconded the motion.

Motion carried unanimously.



CASE NO. 07-V096--TABLED

Action Buildings, 10537 Whitesville Road, to reduce the side yard setback

requirement from 25 ft to 5 ft for a freestanding carport. The property is

zoned RE1.



Mr. Borom made a motion to table this appeal. Mr. Wade seconded the motion.

Motion carried unanimously.





CASE NO. 07-V097?TABLED

Keystone Builders, Inc., 1531 Magnolia Way, to reduce the side corner setback

requirement from 20 ft to 16.95 ft to erect a single family residence. The

property is zoned SFR4.



Mr. Borom made a motion to table this appeal. Mr. Wade seconded the motion.

Motion carried unanimously.





CASE NO. 07-V098?GRANTED

Will White of Woodmont Properties, LLC, 7201 Blackmon Road, to increase the

number of required parking spaces from 400 to 473. The property is zoned RMF2.



Mr. White stated that they are requesting an increase in parking as part of the

new UDO requirements, but the code doesn?t recognize the number of cars that

single families have today. His request of increase is 17% above code

requirements.



There was no opposition present for this appeal



Mr. Borom made a motion to grant this appeal. Mr. Wade seconded the motion.

Motion carried unanimously.





CASE NO. 07-V099--DENIED

Susie Culver of River Signs, LLC, 3443 Macon Road, to add a 32 sq ft LED

message center to existing non-conforming sign; to increase the total allowed

square footage of all three signs from 250 ft to 725 ft combined. The property

is zoned GC.



Ms. Culver stated that they wanted to upgrade the sign located at the old China

Buffet location.



There was no opposition present to this appeal.



Mr. Borom made a motion to deny this appeal. Mr. Wade seconded the motion.

Motion carried unanimously.





CASE NO. 07-V100--DENIED

Robert Teasley of Signs, Inc., 5524-B Whitesville Road, to add a second sign,

which is not allowed. The property is zoned GC.



Mr. Teasley stated that his client is requesting the additional sign for

visibility from the road. It would be a brick monumental sign.



There was no opposition present for this appeal.



Mr. Wade made a motion to deny this appeal. Mr. Borom seconded the motion.

Motion carried unanimously.





CASE NO. 07-V101--GRANTED

Mark Lowery of The Fitts Company, Inc., 1200 Brookstone Centre Parkway, to

reduce the front setback requirement from 3 ft to 0 ft for a sign. The

property is zoned CO.



Mr. Lowery stated that when the installer put in the sign, he put it closer

than what was on the site plan. They are requesting the variance so that they

will not have to remove the sign.



There was no opposition present for this appeal.



Mr. Wade made a motion to grant this appeal. Mr. Borom seconded the motion.

Motion carried unanimously.





CASE NO. 07-V102--GRANTED

Andy Bussey of Larry Bussey, Inc., 1400 17th Street, to reduce the front

setback requirement from 25 ft to 9.5 ft; to reduce the rear setback

requirement from 40 ft to 7.34 ft; and to reduce the side corner setback

requirement fro 25 ft to 0 for a 3rd floor addition to an existing building.

The property is zoned RO.



Mr. Bussey stated that they desire to convert this building into a 3-unit

condo. The current setback requirements will complicate the structural design

of the building.



Mr. Edwards added that the building is existing non-conforming and the addition

was going up not out.



Mr. Edward D. Monsewicz, an adjacent property owner, came forth with questions

regarding the request. Mr. Bussey addressed his concerns and Mr. Monsewicz was

comfortable with the answers.



There was no opposition present for this appeal.



Mr. Wade made a motion to grant this appeal. Mr. Borom seconded the motion.

Motion carried unanimously.



Mr. Wade made a motion to excuse Mr. King from the meeting due to personal

business. Mr. Borom seconded the motion. Motion carried unanimously.



Mr. Wade made a motion to excuse Mr. Lewis from the meeting due to personal

illness. Mr. Borom seconded the motion. Motion carried unanimously.



There being no further business to come before the Board, the meeting adjourned

at 3:15 p.m.
