AN ORDINANCE

An ordinance amending the Columbus, Georgia Pension Plan for General

Government Employees, and the Columbus, Georgia Pension Plan for Employees of

the Department of Public Safety, to provide that the Keep Columbus Beautiful

Commission is added to the list of departments of the Government whose

employees may be eligible members of the Columbus, Georgia Pension Plan for

General Government Employees, to clarify the definition of Eligible Employees

in the Public Safety Pension Plan to include sworn law enforcement officers of

the Columbus Airport Commission, to clarify the definition of normal retirement

age to be consistent with the changes made by Ordinance No. 12-27.

THE COUNCIL OF COLUMBUS, GEORGIA HEREBY ORDAINS:



SECTION 1.



Section 2.26 of the Columbus, Georgia Pension Plan for General

Government Employees is hereby stricken and replaced by a new Section 2.26 to

read as follows:



2.26 Government: The Consolidated Government of Columbus, Georgia, including

the Consolidated Government (the successor to the prior governments of the City

of Columbus, Georgia and of Muscogee County, Georgia), the Water Works

Commission, the Hospital Authority, the Airport Commission, the Golf Authority,

the Trade Center Authority, the Port Columbus Authority, Law Library, the Keep

Columbus Beautiful Commission and any other Board, Authority or Commission

approved by the Council for joint participation in the Plan. The term

?Government? shall also apply to all departments of such governmental entities.



SECTION 2.



Sections 2.16 and 2.22 of the Columbus, Georgia Pension Plan for Public

Safety Employees are hereby stricken and two new sections that read as follows

are substituted therefore:



2.16 Department of Public Safety: Collectively or individually as the context

may indicate, the following divisions of the

Government: Columbus Police Department, Columbus Fire and EMS Department,

Muscogee County Prison, Parks and Recreation Department, Muscogee County

Sheriff?s Department, Marshal of the Municipal Court of Columbus, Georgia,

Department of Emergency Management, Department of Public Services, the

Coroner?s Office, and the Columbus Airport Commission.



2.22 Eligible Employee:

Any Full-Time Employee of the Department of Public Safety who is eligible to

participate in this Plan pursuant to Section 3, excluding:

(a) clerical or administrative personnel of the Department of Public Safety, as

defined in section 2.16 above, who are not sworn law enforcement officers and

whose duties do not require their presence at the scene of an emergency or

crime;

(b) any Employee that is eligible to participate in the Columbus, Georgia

Pension Plan for General Government Employees; and

(c) any Employee who is a Part-Time Employee.





SECTION 3.



Section 2.26 of the Columbus, Georgia Pension Plan for General Government

Employees is hereby stricken and replaced by a new Section 2.26 to read as

follows:



2.34 Normal Retirement Date: The first day of the calendar month coinciding

with or next following the later of:

(a) the date a Member attains age sixty-five (65), or

(b)(i) the fifth (5th) anniversary of the first day of the month coinciding

with or following the date he becomes a Full-Time Employee for employees with

an Employment Date or Adjusted Employment Date before July 1, 2012,

(b)(ii)the tenth (10th)anniversary of the first day of the month coinciding

with or following the date he became a Full-Time Employee for employees with an

Employment Date or Adjusted Employment Date of July 1,2012 or after.





SECTION 4.



Section 2.34 of the Columbus, Georgia Pension Plan for Public Safety Employees

is hereby stricken and two new sections that read as follows are substituted

therefore:



2.34 Normal Retirement Date:

The first day of the calendar month coinciding with or next following the later

of:

(a) the date (a)a Member attains age sixty-five (65), or

(b)(i) the fifth (5th) anniversary of the first day of the month coinciding

with or following the date he becomes a Full-Time Employee for employees with

an Employment Date or Adjusted Employment Date before July 1,2012,

(b)(ii) the tenth (10th)anniversary of the first day of the month coinciding

with or following the date he became a Full-Time Employee for employees with an

Employment Date or Adjusted Employment Date of July 1,2012 or after.



SECTION 5.



This ordinance shall be effective as of July 1, 2012. All necessary

employer and employee contributions owed by Keep Columbus Beautiful and the

Airport Commission shall be made retroactively to said date.



SECTION 6.



All ordinances or parts of ordinances in conflict with this ordinance are

hereby repealed.

Council.
