SUBJECT: Acquisition of Property 6250 Warm Springs Road



INITIATED BY: Laura McCool, Community Reinvestment Division Manager





Recommendation: Approval is requested to accept the property located at 6250

Warm Springs Road for a sum of $10, with a restriction in the deed that limits

the property?s use for public purpose in perpetuity. Approval is also requested

to reimburse the State of Georgia for expenses incurred for 2 appraisals

conducted in 2015, totaling $5,300, used to determine the fair market value of

this property.

Background: In May 2015, Community Reinvestment was contacted by the Georgia

Forestry Commission inquiring if the City was interested in the property

located at 6250 Warm Springs Road. The property is located adjacent to Flat

Rock Park and can be used as an expansion to the park. Currently the driveway

into the park encroaches onto this property.

Community Reinvestment sent a letter to the State of Georgia stating that the

City was interested in obtaining the property via donation. On November 20,

2015, the City was notified that the State of Georgia would consider donating

the property to the City as long as it was used for public use, and they would

be reimbursed for the costs they incurred for appraisals.



Analysis: Acquisition of this property will allow the City to expand Flat

Rock Park. Also, the City will not be required to relocate the driveway into

Flat Rock Park should the property be sold to a private party.



Financial Considerations: The City will provide $5,310 to the State of Georgia

for the Acquisition of this property utilizing Community Development Block

Grant (CDBG) funds. The City will also pay for all legal fees associated with

the transfer.



Legal Considerations: Council must approve all real estate transactions.



Recommendations: Approve a resolution to acquire the property located at 6250

Warm Springs Road for a sum of $10, plus $5,300 for appraisal fees incurred by

the State of Georgia to determine fair market value and legal fees associated

with the transfer.

A RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY LOCATED AT 6250

WARMS SPRINGS ROAD, COLUMBUS, MUSCOGEE COUNTY, GEORGIA.



WHEREAS, the State of Georgia has agreed to donate the property to the

City for a sum of $10, plus $5,300 for appraisal fees incurred to determine

fair market value; and,



WHEREAS, the property is located adjacent to Flat Rock Park and can be

used as an expansion to the park; and,



WHEREAS, Community Development Block Grant (CDBG) funding is available

and can be used for the acquisition of this property.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS

FOLLOWS:



Acquire the property located at 6250 Warm Springs Road for a sum of

$10, plus $5,300 for appraisal fees incurred by the State of Georgia to

determine fair market value and legal fees associated with the transfer.
