SUBJECT: Street Acceptance - That portion of Magazine Lane and that portion of

Lexington Lake Drive located in Section Nine, Lexington Hills



INITIATED BY: Department of Engineering



Recommendation: Approval is requested for the acceptance of a deed to that

portion of Magazine Lane and that portion of Lexington Lake Drive located in

Section Nine, Lexington Hills.



Background: That portion of Magazine Lane and that portion of Lexington Lake

Drive located in Section Nine; Lexington Hills has Thirty-eight (38)

residential lots. The streets have been improved and meet the specifications

for acceptance by the City.



Analysis: A deed has been conveyed to the City conveying that portion of

Magazine Lane and that portion of Lexington Lake Drive located in Section Nine,

Lexington Hills. A description of property is as follows: Those certain tracts

or parcels of land designated as that portion of Magazine Lane, and that

portion of Lexington Lake Drive located in Section Nine, Lexington Hills as

shown on that certain map or plat of survey entitled "Section Nine, Lexington

Hills, Part of Land Lots 4 & 5, 7th District, Columbus, Muscogee County,

Georgia" as prepared by Hobbs Smith & Assoc., Inc., dated September 22, 2014

and recorded in Plat Book 164, Page 161, in the Office of the Clerk of the

Superior Court of Muscogee County, Georgia.



Financial Considerations: No City funds are involved until maintenance is

assumed after the two-year warranty.



Projected Annual Fiscal Impact Statement: No City funds are involved until

maintenance is assumed after the two-year warranty.



Legal Considerations: In accordance with Section 18-3 of the Columbus Code,

all dedicated right-of-way must be accepted by Council.



Recommendations/ Actions: Approve the acceptance of that portion of Magazine

Lane and that portion of Lexington Lake Drive located in Section Nine,

Lexington Hills.











A RESOLUTION

NO. _____

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A DEED THAT PORTION OF MAGAZINE LANE

AND THAT PORTION OF LEXINGTON LAKE DRIVE LOCATED IN SECTION NINE, LEXINGTON

HILLS ON BEHALF OF COLUMBUS, GEORGIA.

WHEREAS, Columbus, Georgia has been submitted a deed conveying that portion of

Magazine Lane and that portion of Lexington Lake Drive located in Section Nine,

Lexington Hills, a full description of property on said deed; and,

WHEREAS, said streets have been improved and meet the required specifications

for acceptance of same; and,

WHEREAS, Engineering Department inspected said streets and recommends

acceptance of same.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That certain deed dated March 2, 2015, conveying to Columbus, Georgia

that portion of Magazine Lane and that portion of Lexington Lake Drive located

in Section Nine, Lexington Hills, and the same is hereby accepted. The Clerk of

Council is hereby authorized to have said deed recorded in the Deed Records in

the Clerk of Superior Court of Muscogee County, Georgia. A copy is hereto

attached and by this reference made a part of this resolution.
