BOARD OF ZONING APPEALS
REGULAR MEETING - 2:00 P.M. ? JANUARY 4, 2006
The Regular Meeting of the Board of Zoning Appeals was held Wednesday, January
4, 2006 at 2:00 P.M., on the 1st Floor of the Government Center Annex in the
conference room, 420-10th Street. The meeting was called to order by Mrs. Leah
Braxton, Chairperson. The board members present were:

Also present representing the Inspections and Code Enforcement Division were
Mr. Danny Cargill, Secretary of the Board, and Mrs. Millicent Burden, Recording
Secretary and Ms. Aronda Smith, representing the Planning Division.
VARIANCES.
Case No. 06-V1?-Granted:
Catina and Walter Jones, 4415 Peru Drive, presented the appeal for a variance
to reduce the front setback requirement from 25 feet to 8 feet for a carport
addition. The property is zoned SFR3.
In her statement, Mrs. Jones stated that she wanted to add the carport to
connect to the front porch so that when she gets out of her car with the kids,
she won?t get wet. She also stated that there are two additional homes in the
neighborhood with similar additions. She will also have gutters and downspouts
on each side.
There was no opposition presented to this appeal.
Mr. Lewis made a motion, which was seconded by Mr. Fox, to grant this appeal.
Motion carried unanimously.
Case No. 06-V2?Granted:
Mr. Jim Rowe, 9149, Travelers Way, presented the appeal for a variance to
reduce the rear setback requirement from 50 feet to 17 feet to erect a storage
building. The property is zoned RE1.
In his statement, he wants to erect a storage building that will be constructed
from the same material that is used in the front of his home. He intends to
compliment his home with the addition. He mentioned the tract in the rear was
a 60 acre agricultural parcel.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Fox. Motion carried
unanimously.
Case No. 06-V3?Granted:
Mr. Don W. Duncan, Duncan/Lovelace Architects, 2424 Double Churches Road,
presented the appeal for a variance to change the side setback requirement from
12 feet to 10 feet on the north side and 12 feet to 9 feet 4 inches on the
south side of the building. The property is zoned RO. This request is
required due to site size constraints.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. King, to grant this appeal.
Motion carried unanimously.
Case No. 06-V4?Granted:
Nathan McBride and George Woodruff, III, 5041 and 5051 Warm Springs Road,
presented the variance to reduce the minimum lot width requirement from 75 feet
to 70.0 feet to allow for proposed building. The property is zoned RO.
In their statement, they propose to erect a structure between lot 400 and lot
600. The structure will look like the existing structures alongside it.
Ms. Cynthia Neal came forward with a question regarding the intention of Mr.
Woodruff. She was unclear about the process and the proposal that was taking
place and just wanted some clarity. When the drawings and information were
given to her by Mr. Woodruff and the board, Ms. Neal was satisfied and
expressed that she did not oppose the appeal for the request.
Mr. King made a motion, which was seconded by Mr. Lewis to grant this appeal.
Motion carried unanimously.
Case No. 06-V5?Granted:
Mr. Bill Gordy of Gordy Engineering and Assoc., 4521 17th, presented the appeal
for a variance to reduce the aisle width from 24 feet to 22 feet, and to reduce
the parking space depth from 20 feet to 18 feet to increase parking spaces from
20 to 34. The property is zoned GC.
Board members expressed concern about the parking width and depth regarding the
larger vehicles like the SUV?S.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Lewis to grant this appeal.
Motion carried 2 to 1.
Case No. 06-V6-Granted:
Mr. Paul Riddle of Humphrey?s Assoc., 1838 Victory Drive, presented the appeal
for a request for a variance to increase the parking requirement from 110
spaces to 261 spaces. The property is zoned HMI.
In his statement, Mr. Riddle mentioned that his company was the contractor for
Road America, which is a call center that services customers worldwide. The
increase is requested due to the volume of employees that will need parking.
The landscaping will meet the requirements of the tree ordinance as well.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis to grant this appeal.
Motion carried unanimously.
Case No. 06-V7?-Granted:
Mr. Danny Curtiss of Curtiss Signs Inc. and Mr. John Boyer of Morningside
Presbyterian Church, 4142 Weems Road, presented the appeal to request a
variance to increase the sign area from the requirement of 15 square feet to 40
square feet. The property is zoned SFR2.
Mr. Curtiss stated that he would be replacing the two existing signs that are
on the property. The old ones will be discarded and the new sign will be newer
and cleaner and will not obstruct visibility on the road.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. King, to grant this appeal.
Motion carried unanimously.
Case No. 06-V8?-Tabled:
Appeal of Signs Inc., 952 54th Street, for a variance to increase the sign area
from the requirement of 15 square feet to 60 square feet. The property is
zoned SFR1.
There was no representation present for this appeal. The case will be tabled
until the February meeting.
Case No. 06-V9 & V10?-Granted:(Mrs. Leah Braxton excused herself from this case
due to conflict of interest)
Scott Allen of 2WR/Andras Architects, 1640 & 1658 Rollins Way, presented the
appeal for a request for a variance to allow building signage to be above the
roofline. The property is zoned GC.
Mr. Allen opened his statement by first apologizing for any rules or codes that
his company may have violated. It was completely unintentional. The signs
will be backed after the decision from the board. He also stated that both
buildings will not use any pylon signs for their businesses. Any future
tenants will be advised that they will not be able to use any as well. Also,
their signs will be the same type structure as the existing one on the front.
Mr. Chris Meacham, (attorney) Polly Bell (MEA Credit Union), and Buzzy Mueller
(consultant for MEA) came forth with questions regarding signs being placed on
the rear of the building. After their questions were addressed, they did not
express any opposition to the variance request.
Mr. King made a motion, which was seconded by Mr. Lewis. Motion carried
unanimously.
Case No. 06-V11?Granted:
Mr. Jon Ya Hasan and Mr. Michael Moore, 3321 North Lumpkin Road, presented the
appeal for a request for a variance to reduce the required parking spaces of 32
to 22 parking spaces. The property is zoned LMI.
In his statement, Mr. Hasan said that the building was purchased from the city
by Mr. Moore and his congregation.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Lewis. Motion carried
unanimously.
Case No. 06-V12?Granted:
Mr. Will White of Inverness II, LLC, 7375 Old Moon Road, presented the appeal
for a request for a variance to permit an existing apartment building to remain
29.9 feet from the rear line where the setback is 40 feet. The property is
zoned RO.
Mr. White stated that the building was in an area that was recently rezoned and
the rear of the property is used for concrete barricade storage assumedly.
Also the financing arm requested this variance to be reassured that they would
not be required to tear it down at a later date.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Fox. Motion carried
unanimously.
Case No. 06-V13?Granted:
Kevin Benford of Action Buildings, 1036 54th Street, presented the appeal for a
request for a variance to change the rear setback requirement from 30 feet to
11 feet. The property is zoned SFR2.
In his statement, he mentioned that the owner would like to sub-divide the lot
to put two more rental properties on the lot. He provided pictures and the
appropriate drawings to support his proposal.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Lewis. Motion carried
unanimously.
CASE TABLED FROM DECEMBER 7TH MEETING:
Case No. 05-V182?Denied
Appeal of Powertel/Atlanta, 1720 Warm Springs Road, for a request for a
variance to reduce the rear yard setback requirement from 300 feet to 189 feet,
in order to construct a telecommunication tower facility. The property is
zoned NC.
This request was denied due to 2nd meeting ?lack of representation.
END OF VARIANCES.
The minutes of the regular meeting of December 7, 2005 were approved as
presented.
A motion was made by Leah Braxton to excuse David Fox from the December
meeting, and was seconded by Ralph King. Motion carried unanimously.
A motion was also made by Ralph King to excuse Billy Edwards from the January
meeting, and was seconded by David Fox. Motion carried unanimously.
There being no further business to come before the Board,
the meeting adjourned at 3:34 p.m.
