 SUBJECT:	Balcony - Encroachment on Broadway Right-of-way       
 INITIATED BY: Engineering           
 Recommendation:	Approval is requested for a permanent encroachment at    
 1109 Broadway for the construction of a balcony that will extend six feet six    
 inches into the public right-of-way from the existing building face with a    
 minimum height of eight feet above the sidewalk.       
 Background:	City Code Section 4.2.22 Encroachments into Public    
 Rights-of-way allows for encroachments into rights-of-way up to five feet, but    
 not six feet six inches.  The Traffic Engineering Division received site plans    
 from Mr. Keith Milligan, owner and operator, requesting a variance to the City    
 Code requirements to extend the balcony six feet six inches into the    
 right-of-way. The balcony is designed to be counter levered with no supports    
 installed in the sidewalk area.       
 Analysis: An architectural drawing is attached showing the proposed balcony.    
 The City has authorized this type of permanent encroachment in the past with    
 the condition that should the encroachment ever become a conflict with any    
 public improvements, the encroachment shall be removed at no cost to the City.       
 Financial Considerations: There are no costs to the City beyond administrative    
 cost for permitting and inspections.       
 Projected Annual Fiscal Impact Statement: There are no projected annual cost to    
 the City.       
 Legal Considerations: Council must approve all permanent encroachments into    
 public right-of-way.       
 Recommendations/ Actions: Approve the encroachment for the balcony at 1109    
 Broadway.                   
 A RESOLUTION       
  NO.  _____   
 A RESOLUTION AUTHORIZING A PERMANENT ENCROACHMENT OF A BALCONY SIX FEET SIX    
 INCHES INTO THE PUBLIC RIGHT-OF-WAY AT 1109 BROADWAY BEGINNING AT A MINIMUM    
 HEIGHT OF EIGHT FEET ABOVE THE SIDEWALK; SAID ENCROACHMENT IS APPROVED WITH THE    
 CONDITION THAT SHOULD THE BALCONY EVER BECOME A CONFLICT WITH ANY FUTURE PUBLIC    
 IMPROVEMENT, THE BALCONY SHALL BE REMOVED AT NO COST TO THE CITY.       
 WHEREAS, Mr. Keith Milligan desires to construct a building addition to the    
 existing building/business with the addition of a balcony over the City    
 sidewalk; and,       
 WHEREAS, the architectural design will eliminate any supports or obstructions    
 in the sidewalk; and,       
 WHEREAS, the Engineering and Inspections and Code departments have reviewed the    
 architectural drawing and concur with the request, to allow a permanent    
 encroachment into the Broadway right-of-way with conditions.        
 NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:    
 That a permanent encroachment of a balcony six feet six inches with a minimum    
 height of eight feet above the sidewalk into the public right-of-way at 1109    
 Broadway is hereby authorized; said encroachment is approved with the condition    
 that should the balcony ever become a conflict with any future public    
 improvement, the balcony shall be removed at no cost to the City.
