A RESOLUTION
NO.
WHEREAS, in December, 2010, a federal jury awarded $306,000 to the Plaintiff in
the case of Hickey v. Columbus Consolidated Government (U.S. District Court
Case No. 4:07-cv-00096-CDL);
WHEREAS, Columbus has filed an appeal in this matter with the United States
Court of Appeals for the Eleventh Circuit;
WHEREAS, the parties have discussed the matter with counsel and have agreed to
a settlement of this matter in lieu of further appeal, litigation, or possible
retrial.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:
We hereby authorize the Mayor, City Attorney, and Finance Director to make
payment of $155,000 to Plaintiff and his attorneys as compensatory damages,
payment of related retirement benefits, and payment of $186,988.87 for
attorney?s fees and costs as ordered by the U.S. District Court. The Mayor,
City Attorney, and Finance Director are further authorized to execute a
settlement agreement and all appropriate settlement documents to this effect.
