SUBJECT: Quit Claim Deed - 4250 Warm Springs Road

Recommendation: Approval is requested to execute a Quit Claim Deed with Warm
Springs, LLC., on property located at 4250 Warm Springs Road for the purpose of
the City of Columbus, Georgia , waive the Utility Easement referred to as
BellSouth Telecommunications, LLC., d/b/a/ AT&T Georgia.
Background: The property located at 4250 Warm Springs Road (Tax Map #
083-027-082b) is being sold and a Quit Claim Deed is needed from the City and
AT&T to clear up the issue of an abandoned Telecommunication line referred to
as "TC" on attached plat. AT&T has executed a Quit Claim Deed on their
interest. All other easements traversing the property will remain in full
force and effect.
Analysis: The Quit Claiming of said property will allow the consummation to
clear up title for closing and allowing development of this property adding to
the City's Tax Digest.
Financial Considerations: There is no expense to the City
Projected Annual Fiscal Impact Statement: NA
Legal Considerations: The Council must approve the action by resolution.
Recommendations/ Actions: Authorizing the City Manager to execute the Quit
Claim Deed with Warm Springs, LLC at 4250Warm Springs Road to a waive the
Utility Easement referred to as BellSouth Telecommunications,LLC d/b/a AT&T
Georgia.

A RESOLUTION AUTHORIZING TO EXECUTE A QUIT CLAIM DEED TO WARM SPRINGS, LLC ON
PROPERTY LOCATED AT 4250 WARM SPRINGS ROAD FOR THE CITY TO WAIVE THE UTILITY
EASEMENT REFERRED TO AS BELLSOUTH TELECOMMUNICATIONS, LLC D/B/A AT&T GEORGIA
SHOWN AS ("TC") ON ATTACHED PLAT.
WHEREAS, the "TC" line has been abandoned and designated as "R.I.P." by AT&T
and has Quit Claimed their interest of the property to Warm Springs, LLC; and,
WHEREAS, the Quit Claim Deed from the City will allow the interested party to
proceed with their plans to develop said site; and,
WHEREAS, all other utility easements traversing the Property will remain in
full force and effect.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the City Manager is hereby authorized to execute a Quit Claim Deed with
Warm Springs, LLC on property located at 4250 Warm springs Road for the City to
waive the Utility Easement referred to as BellSouth Telecommunications, LLC.,
d/b/a AT&T Georgia shown as "TC" on attached Plat.
