SUBJECT: City Right of Way Agreement for Intersection Improvement

@ Mutec Drive(Corporate Ridge Parkway)/Woodruff Farm Road

Recommendation: Approval is requested to execute a City Right of Way Agreement

(attached) with the Georgia Department of Transportation (DOT) for a County

Contract for Intersection Improvement of Mutec Drive (Corporate Ridge Parkway)

@ Woodruff Farm Road.



Background: DOT will assist the city of Columbus, Georgia in a County Contract

to improve the Intersection Mutec Drive (Corporate Ridge Parkway)@ Woodruff

Farm Road, Project No. PRC10-S011-00(685), Muscogee County.



Analysis: Governor Sonny Perdue has offered a State Incentive Package for

AFLAC Expansion Improvements, therefore, the city of Columbus, Georgia has

requested State Aid Count Contracts with the DOT to improve the Intersection of

Mutec (Corporate Ridge Parkway)@ Woodruff Farm Road, Project No.

PRC10-S011-00(685), Muscogee County.



Financial Considerations: DOT had agreed to pay an estimated amount of

$2,500,000.00 for DOT Road Improvements in the Corporate Ridge area. They have

just advised that they only have $1,000,000.00 toward this project. The

Estimated cost is $1,224,000.00. This project includes the Bridge component

which is in the CIP (Project Line # 21035) has $605,680.00. This project is

not expected to have any Right of Way costs or Utility Relocation, as the plans

are presented, at this time.



Legal Considerations: The City Attorney disagrees with the indemnification

paragraph, but understands that DOT will not change the paragraph in the

agreement, therefore, to participate in this program, the City has to accept it

as does every government entity, statewide.



Recommendations/ Actions: Approve the resolution authorizing the Right of Way

Agreement and subsequent agreements necessary to implement this project.

A RESOLUTION AUTHORIZING TO ENTER INTO A RIGHT OF WAY AGREEMENT WITH THE

GEORGIA DEPARTMENT OF TRANSPORTATION (DOT) FOR A COUNTY CONTRACT FOR

INTERSECTION IMPROVEMENT AT MUTEC (CORPORATE RIDGE PARKWAY)/WOODRUFF FARM ROAD

DR./TRANSPORT BLVD.

WHEREAS, DOT will assist the city of Columbus, Georgia, a Consolidated

City/County Government, in a County Contract to improve the intersection of

Mutec (Corporate Ridge Parkway), Project PRC10-S011(685) Muscogee County; and,

WHEREAS, a letter dated October 6, 2005 from the Governor's Office pledged

$2,500,000 of State Incentive Package for AFLAC toward DOT Road Improvements;

and,

WHEREAS, if necessary, the City will pay for right of way and utilities

re-location from PAVING Funding; and,

WHEREAS, the project will extend wholly within the corporate limits of

Columbus, Georgia, under the laws of the state of Georgia.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to execute a City Right of

Way Agreement and subsequent agreements necessary to implement the project with

the Georgia Department of Transportation (DOT) for a County Contract

Intersection Improvement of Mutec (Corporate Ridge Parkway), Project No.

PRC10-S011(685), Muscogee County
