A RESOLUTION AUTHORIZING TO ENTER INTO AN AMENDMENT TO THE AGREEMENT FOR
INDIGENT DEFENSE SERVICES BETWEEN CIRCUIT PUBLIC DEFENDER OFFICE OF THE
CHATTAHOOCHEE JUDICIAL CIRCUIT AND MUSCOGEE COUNTY IN THE AMOUNT OF $136,799
FROM FEBRUARY 2017 TO JUNE 2017 AND AUTHORIZE AN ADDITIONAL PAYMENT TO THE
GEORGIA PUBLIC DEFENDER COUNCIL (GPDC) IN THE AMOUNT OF $109,268 PAID IN FOUR
MONTHLY INSTALLMENTS OF $27,317 EACH.
WHEREAS, the Circuit Public Defender Office of the Chattahoochee Judicial
Circuit was created in January 2005 by the Georgia Indigent Defense Act of 2003
and provides that a consolidated government may contract with the circuit
public defender for the provision of criminal defense for indigent persons; and,
WHEREAS, the Columbus Consolidated Government (CCG) desires for the Circuit
Public Defender to provide the criminal defense for indigent persons in
Recorder?s Court; and,
WHEREAS, the contract amendment specifies the additional amount of $109,268 for
state paid personnel and administrative fee for the period of February 1, 2017
to June 30, 2017 and an additional amount for Columbus Consolidated Government
personnel (one investigator and an attorney for Saturday/Holiday sessions at
$150 per session) and other operating expenses totaling $27,531, and under the
contract, as amended, Muscogee County?s total prorated share of all circuit
expenses under the contract, as amended, will be $1,619,293.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
That the Mayor or the City Manager is hereby authorized to enter into an
amendment to the agreement for Indigent Defense Services between Circuit Public
Defender Office of the Chattahoochee Judicial Circuit and Muscogee County in
the amount of $136,799 from February 1, 2017 to June 30, 2017 and authorize
payment to the GPDC in the amount of $109,268 to be paid in four monthly
installments of $27,317 with the remaining $27,531 of personnel and operating
expenses to be paid directly by the CCG.
