Subject: (EXCP-10-14-2312) Special Exception Use request to operate a Place of
Worship (in excess of 250 seats) / Private School / Day Care Center (Type III)
at 2000 Kay Circle, 1703 and 1723 Sheffield Drive, and 1820 Box Road.
St. Anne?s Catholic Church has submitted an application for the Special
Exception Uses cited above. The properties are located in the SFR2
(Residential Estate 1) and GC (General Commercial) zoning districts. The site
for the existing place of worship and associated uses 22.91 acres. The purpose
of the Special Exception Uses are to bring the church and the school into
zoning conformity and to permit the use of a Day Care Center (Type III) in a
residential zoning district:
(1) Access. Is or will the type of street providing access to the use be
adequate to serve the proposed special exception use?
Kay Circle and Sheffield Drive are classified as local streets that will
provide adequate access for the proposed use. Box Road is classified as a
collector and will also provide adequate access. The existing Level of Service
(LOS) will remain as it is.
All driveways/accesses are existing.
(2) Traffic and Pedestrian Safety. Is or will access into and out of the
property be adequate to provide for traffic and pedestrian safety, the
anticipated volume of traffic flow, and access by emergency vehicles?
There will be no impact to the transportation system, nor will there be any
impact to pedestrian safety.
(3) Adequacy of Public Facilities. Are or will public facilities such as
schools, water or sewer utilities, and police or fire protection be adequate to
serve the special exception use?
Services such as water, sewer, utilities, police, and fire protection will be
adequate and serve the proposed use at this location.
(4) Protection from Adverse Affects. Are or will refuse, service, parking and
loading areas on the property be located or screened to protect other
properties in the area from such adverse effects as noise, light, glare or odor?
Off-street parking is utilized on-site. No side and rear and buffers are
required since the site is surrounded by SFR1 zoning classification. Street
buffer shall be provided in accordance of Section 4.5.8. of the UDO. External
dumpsters/compactors and lighting are addressed in the UDO. Noise impacts are
addressed in the City Code.
(5) Hours of Operation. Will the hours and manner of operation of the special
exception use have no adverse effects on other properties in the area?
The hours of operation for these uses will be consistent with current hours of
operation of the existing facilities.
(6) Compatibility. Will the height, size or location of the buildings or
structures on the property be compatible with the height, size, character or
location of buildings or other structures on neighboring properties?
The height, size and location of the structures are compatible with other
structures on neighboring properties.
Council District: District 1 (Barnes)
One hundred and one (101) property owners within 300 feet of the property have
been notified by mail of the proposed Special Exception Uses. The Planning
Department received one comment inquiring about this case.
Additional Information:
A special exception use is needed in order to operate a Day Care Center (Type
III) on the campus of St. Anne?s Catholic Church. The applicant will utilize
existing space on campus to accommodate the new use. The applicant was also
urged by the Planning Department to bring the current uses into zoning
compliance.
The Planning Advisory Commission recommended approval at the November 19, 2014
meeting.
The Planning Department recommends that the Council approve the Special
Exception request.
