SUBJECT: Declare surplus, Delete street segment / right-of-way of

Brookstone Centre Parkway and Quit Claim to 2300 Parkway LLC



INITIATED BY: Engineering







Recommendation: Approve the attached Ordinance to delete street segment

and right-of-way of Brookstone Centre Parkway from the Official Street Map.

Approve a subsequent resolution to Quit Claim the City's interest in the street

segment and right-of-way of Brookstone Centre Parkway as indicated on plat

titled Property of Developers-Investors, Inc., Extension of Brookstone Centre

Parkway, Dated November 15, 2000.



Background: The City accepted a deed to this portion of Brookstone

Centre Parkway by Resolution #566-95 on November 14, 1995. Plat titled Part of

Brookstone Centre Parkway, dated September 1995 recorded in plat book 129 folio

60. On December 19, 2000 the City accepted a deed to an extension of Brookstone

Centre Parkway by Resolution # 622-00 for which the alignment of Brookstone

Centre Parkway had changed leaving a 0.084 acres remnant of right-of-way owned

by the City. The Engineering Department received a request from 2300 Parkway,

LLC that the City Quit Claim their interest in the above mentioned portion of

street segment / right-of-way.



Analysis: The City no longer has current or future need for this portion of

right-of-way as shown on plat prepared by Moon, Meeks, Mason and Vinson, titled

Property of Developers-Investors, Inc., Extension of Brookstone Centre Parkway,

Brookstone Centre, Lying in Land Lot 77, 8th District, Columbus, Muscogee

County, Georgia, Dated November, 15, 2000 and recorded in Plat Book 142, Folio

70. All existing utility easements of record remain in effect and providing

easements of appropriate width as required by the applicable utility companies

will be reserved for unknown utilities.



Financial Considerations: The City will no longer be responsible for

maintenance of the noted 0.084 acres of right-of-way.



Legal Considerations: These actions require Council Approval



Recommendations/ Actions: Approve the attached Ordinance to delete street

segment and right-of-way of Brookstone Centre Parkway from the Official Street

Map. Approve a subsequent resolution to Quit Claim the City's interest in the

street segment and right-of-way of Brookstone Centre Parkway as indicated on

plat titled Property of Developers-Investors, Inc., Extension of Brookstone

Centre Parkway, Dated November 15, 2000.
