SUBJECT: Disposition of property located on Ironstone Drive
INITIATED BY: Community Reinvestment Division
Recommendation: Approval is requested to dispose of a portion of the property
(.096 acres) located at 5646 Rockhurst Drive, adjacent to 5745 Ironstone
Drive, for $3,302 which covers the cost of the quit claiming the property,
surveying work, appraisal fee, attorney and title fees.
Background: In May 2015, Community Reinvestment was contacted by Mr. and Mrs.
West who are the property owners of 5745 Ironstone Drive. They were in the
process of trying to obtain a permit to construct a structure over the
in-ground pool in their backyard. During that time it was discovered that their
pool and storage shed encroached on City property located at 5646 Rockhurst
Drive, which is part of Bull Creek Watershed #25.
The Engineering Department contacted the USDA to determine what could be done
to correct the problem. The USDA stated that the City could dispose of this
portion of the watershed as long as a flood easement remained on the property.
The breakdown in costs are $300 property, $375 appraisal, $1,865 survey work,
$262 legal fees, and $500 title work for a total cost of $3,302. The homeowners
at 5745 Ironstone Drive have agreed to the pay the costs.
Analysis: This property is of no appreciable monetary value and is not needed
for any public purposes. Accordingly, disposition of a portion of this property
will allow the homeowner to proceed with constructing a structure over the
pool. Also the fixtures in their current locations will no longer encroach on
City watershed property.
Financial Considerations: There will be no cost to the City. All expenses
incurred by this transaction will be paid by the homeowner at 5745 Ironstone
Drive.
Legal Considerations: Council must approve all real estate transactions.
Recommendations: Approve a resolution to dispose of a portion of the property
located at 5646 Rockhurst Drive, adjacent to 5745 Ironstone Drive, for $3,302
which includes the cost of the property, surveying work, appraisal fee,
attorney and title fees.

A RESOLUTION AUTHORIZING THE DISPOSITION OF A PORTION OF THE PROPERTY LOCATED
AT 5646 ROCKHURST DRIVE, COLUMBUS, MUSCOGEE COUNTY, GEORGIA.
WHEREAS, the pool and storage shed located at 5745 Ironstone Drive encroaches
on .096 acres of City property located at 5646 Rockhurst Drive; and,
WHEREAS, the property owners of 5745 Ironstone Drive have requested that the
City quit claim its rights to the .096 acre portion of 5746 Rockhurst Drive
where the encroaching fixtures are located; and,
WHEREAS, the portion of the property located at 5646 Rockhurst Drive is part of
Bull Creek Watershed #25; and,
WHEREAS, the City has approval from the USDA to sell this portion of the
property as long as flood easements remain; and,
WHEREAS, it has been determined by staff that the .096 acres to be quitclaimed
serves no public purpose and has no appreciable monetary value.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
The City Manager and Clerk of Council are authorized to execute all documents
necessary to quitclaim .096 acres of the property located at 5646 Rockhurst
Drive, as marked on the attached plat, subject to the required flood easement,
for $3,302 which includes the cost of quit claiming the property, surveying
work, appraisal fee, attorney and title fees.
