SUBJECT: Unified Development Ordinance variance for sidewalks at 3151

Tower Road



INITIATED BY: Department of Engineering







Recommendation: Approval is requested authorizing a variance to the City Code

7.10 of the Unified Development Ordinance (UDO) that requires the installation

of sidewalks as part of all commercial and residential development.



Background: The Traffic Engineering Division received a request to postpone

sidewalk construction from Dangie Construction for the Adams Project at 3151

Tower Road because there are no residential houses and no existing sidewalks

in this area.



Analysis: The Traffic Engineering Division reviewed the request and because

there are no residential houses and no existing sidewalks in this area

recommends approval of the variance, with provisions . The provisions are in

the resolution.



Financial Considerations: No cost to the City.



Projected Annual Fiscal Impact Statement: The owner shall receive written

notification from the Director of Engineering when the conditions described in

the variance are trigger and the need for the construction of the five foot

(5?) concrete sidewalk along the frontage 3151 Tower Road shall be required.



Legal Considerations: A variance to the City Code requirements requires

Council approval.



Recommendations/ Actions: Approve the recommended variance to City Code 7.10

of the Unified Development Ordinance (UDO) for the installation of sidewalks

described herein.

RESOLUTION

A RESOLUTION AUTHORIZING A VARIANCE TO CITY CODE SECTION 7.10.1 THAT

REQUIRES SIDEWALKS IN ALL RESIDENTIAL, COMMERCIAL AND INDUSTRIAL DEVELOPMENTS

FOR THE NEW OFFICE AND STORAGE BUILDING BEING CONSTRUCTED AT 3151 TOWER ROAD;

ALLOWING THE SIDEWALK CONSTRUCTION TO BE POSTPONED UNTIL ANY ADJACENT

COMMERCIAL PROPERTIES ALONG TOWER ROAD OR BUILDERS WAY INSTALL SIDEWALK OR THE

CITY INSTALLS SIDEWALK.



WHEREAS, construction plans were approved for the construction of the

afore mentioned Office that includes the construction of a five (5?) concrete

sidewalk in accordance to City Code Section 7.10.1 along the East side of Tower

Road and the Southeast side of Builders Way for the length of this property;

and,



WHEREAS, there are no existing sidewalks on either side of Tower Road or

Builders Way; and,



WHEREAS, the construction of the new Office is nearing completion; and,



WHEREAS, postponing the sidewalk construction is recommended by the

Engineering Department, with two provisions:

(1) Should any of the adjacent commercial properties along Tower Road and/or

Builders Way install sidewalk, then the owner shall be responsible for

installing the sidewalk as currently approved along the property frontage; or,

(2) Should any city project install sidewalk along Tower Road and/or Builders

Way, that includes sidewalk across this property, the owner shall be

responsible for the expense of the sidewalk along this property; and,



WHEREAS, the owner shall receive written notification from the Director

of Engineering when the conditions described herein trigger the need for the

construction of the five foot (5?) concrete sidewalk along the frontage 3151

Tower Road.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY ORDAINS:



I.

THAT A VARIANCE IS HEREBY AUTHORIZED FOR THE NEW OFFICE AND STORAGE

BUILDING BEING CONSTRUCTED AT 3151 TOWER ROAD TO CITY CODE SECTION 7.10.1

ALLOWING THE CONSTRUCTION OF THE REQUIRED FIVE FOOT (5?) CONCRETE SIDEWALK TO

BE POSTPONED UNTIL THE CONDITIONS DESCRIBED HEREIN TRIGGER THE CONSTRUCTION OF

SIDEWALK ALONG THE FRONTAGE OF THIS PROPERTY.



II.

THIS CONDITION SHALL BE RECORDED IN ANY DEED TO THE SUBJECT PROPERTY

AND SHALL RUN WITH THE SUBJECT PROPERTY.



Introduced at a regular meeting of the Council of Columbus, Georgia held on the
